昨天小米公司以不正当竞争为由把360诉至海淀法院，法院随后受理了此案。此事的大致经过如下：今年1月，小米宣布其应用商店全线下架360软件，因为小米认为，360要求用户安装的“雷电OS”，存在偷跑流量的行为。360则做出《我们反对小米扼杀雷电OS的做法》的声明，宣称“雷电OS比MIUI轻巧、省电、快速、没有预装软件”、“与MIUI相比，雷电OS体积小，运行快，安全性能好，省电省流量，自然赢得用户喜爱”。
小米在起诉书中表示，所谓的雷电OS根本没有更换手机原有的MIUI系统，其本质上只是一款伪装成手机操作系统的手机APP，此外，小米还称从去年8月-今年1月不断接到用户投诉，手机在安装了雷电OS后出现了各种问题。
小米公司认为，360在手机生产销售、手机应用分发及智能手机操作系统等方面与小米具有直接竞争关系，系同业竞争者。360在没有任何事实依据的情况下，通过声明捏造散布所谓雷电OS比MIUI具有诸多优势等虚假事实，直接损害了小米公司的商业信誉。同时，360安全卫士作为雷电OS的惟一捆绑安装渠道，并在其官方微博和媒体上公开发表声明，为酷睿蒙公司（雷电OS研发公司）诋毁商誉及虚假宣传的行为进行背书并大力推荐，360与酷睿蒙公司共同实施了诋毁小米公司商誉及虚假宣传等不正当竞争行为。
最后，小米要求法院判令360以及酷睿蒙公司立即停止侵权行为、赔礼道歉并赔偿经济损失2000万元。
