北京商报记者实地走访发现，该地址的店铺招牌是渝味小厨，而在玻璃门上却贴着“好乐披萨”字样。进入店内坐下，服务员递来一份菜单，菜单正面是川味小炒，背面上半部分却是各种比萨。美团外卖和饿了么的配送员接连出入，服务员对着后厨高呼，“催一下好乐披萨”！北京商报记者发现，该商铺并未根据《食品经营许可管理办法》的要求将《食品经营许可证》在经营场所的显著位置悬挂或者摆放。对于好乐披萨的资质问题，服务员也并未给出回应。
数个商家共用同一执照的情况并不鲜见。在北京市食药监局召开的关于加强网络食品经营的动员会上，有业内人士透露，此前曾在中国传媒大学附近发现12个商家使用同一套营业执照和餐饮许可证。“团结湖有一家主营烤肉拌饭的餐饮，在商家简介中却显示‘沙县小吃’，店门口有两个招牌，使用的执照却是已过期的‘庆丰包子铺’。”
昨日，东城区食药监局接到投诉举报后对渝味小厨进行了检查，发现该商家的《食品经营许可证》为“渝味小厨”，东城区食药监局要求该企业对平台上“好乐披萨”商家进行整改。相关负责人表示，此类一家店用两个“马甲”的情况不合规，商家只允许使用符合证照的店铺名，第三方平台有责任对入网商家一一核查。

监管部门相关人士表示，此类商家存在外包嫌疑，但取证难度较高。如果承包后厨的负责人同样是该餐厅的法人，两人分时段分项目经营，就没有问题。此前北京市食药监局曾就早餐违规转租现象组织开展全市早餐服务企业食品安全检查，类似问题查出多起，但固化证据并不容易。
平台商家合谋

目前，北京市出台的《办法》还在试行阶段，其他省市尚未有相关政策落地。明确第三方平台责任的法规只有《食品安全法》第六十二条，“网络食品交易第三方平台提供者应当对入网食品经营者进行实名登记，明确其食品安全管理责任；依法应当取得许可证的，还应当审查其许可证。网络食品交易第三方平台提供者发现入网食品经营者有违反本法规定行为的，应当及时制止并立即报告所在地县级人民政府食品药品监督管理部门；发现严重违法行为的，应当立即停止提供网络交易平台服务”。
监管收严

第三方平台也将承担责任。《办法》规定，第三方平台提供者要对入网食品经营者进行实名登记和主体经营资质准入的审查，《食品经营许可证》要在醒目位置公示。北京市食药监局市场监管处处长李江表示，相关证照点开后必须有清晰可见的大图，证照模糊不清不能通过。
食药监部门相关人士坦言，无证经营查处存在难度，行政执法和公安执法有很大不同。接下来会加强与工商、公安、互联网信息主管部门、电信主管部门等部门间的配合协作，对网络食品经营监管发现的违法违规行为发现一起就查处一起，并及时通报有关部门。
