今年央视的“3·15”晚会,曝光了网络订餐平台“饿了么”。食物制作现场“污水横流”,厨师“尝完的菜扔回锅里”,平台引导商家虚构地址、虚假宣传,甚至默认无照经营的黑作坊入驻……虽然北京食药监局在节目刚播出就查处了“饿了么”五店合一食品加工点,上海食药监局也约谈了“饿了么”相关负责人,但习惯叫外卖的年轻人还是吐槽,感觉“像吃了一只苍蝇”。

“互联网+”为我们的生活带来巨大变化,从上网购物到手机叫餐,衣食住行都已经被网络改变。然而,“饿了么”的情况也揭示,“野蛮生长”难免积累下种种矛盾和问题,“井喷”的背后可能是泥沙俱下、良莠不齐的消费品质。“饿了么”虽然是个案,但在“数字化生活”的大趋势下,不及时构建起良性的市场秩序,就会导致劣币驱逐良币,成为既影响行业发展、更降低公众福利的问题。

“互联网+”的概念意味着,互联网要与其他行业搭配,才能产生乘数效应,进一步提升价值。以网络订餐服务为例,从消费者下单到食物的制作、配送,涉及的主体很多,远不是一个软件那么简单。我们对一家餐馆、一个网站怎么管很在行,但一个网络平台连接起无数餐馆,构建起一个庞大的系统,这该怎么管,可能就缺少点经验了。“互联网+”时代,会产生很多社会治理的新课题。

与网络约租车等服务一样,网络餐饮消费如何准入、如何监管,将成为今后很长一段时间里备受关注、也极具挑战的问题。对于这样的新业态,既要避免“一管就死”,管得太细太具体,扼杀了行业的活力;也要避免“一放就乱”,监管跟不上,让投机者得利、消费者受损。这确实考验着管理部门宏观的智慧、微观的耐心

从监管层面讲,必须界定好外卖平台与接入餐饮商家之间的关系,规定好责、权、利的主体。平台负哪些责任、餐馆负哪些责任,出现什么样的问题应该由谁来管,“谁的娃娃谁抱走”。同时加大市场检查系统、市场评价系统的建设,线上线下一起建构起良性的市场秩序。酝酿许久、即将出台的网络食品经营监督管理办法,对网络平台的义务做了明确表述;部分省市也做了一些管理创新,包括实行平台向监管部门报送制度等等,都在尝试勾勒清楚这个责权利的框架。

对于各个网络订餐平台来说,也应该有更多自律意识。互联网经济竞争激烈、更新换代快,然而,“唯品质不破”。中国消费者必然会走过图快图便宜的阶段,进入“品质时代”。不管是坚守严格的审查底线,还是以即时视频监督等方式增加透明度,网络平台方显然有很多工作可以去做——眼里不能只是圈更大的地、做更大的份额。没有品质与口碑保障,丢失市场与份额是“分分钟”的事儿。

不管是网络订餐,还是其他基于网络的服务,对于阶段性发展之后暴露出来的问题,不应简单“唱衰”甚至“一刀切”地禁止,而应该视为改进与升级的契机。衣食住行无小事,这样的治理,表面看是管理互联网平台,但本质上是管理公众的生活,可以说是另一种“民生”。政府部门的监管模式,必须以改革之心、利民之志,努力实现创新升级。
