  实施食品召回是加强生产加工后续监管的一种有效措施。食品召回制度与食品质量安全市场准入制度相互配合,共同作用,对于进一步强化食品生产监管,有效应对食品安全突发事件具有非常重要的作用。


  3月15日,北京大学公众参与研究与支持中心发布的《中国食品安全监管透明度观察报告》(以下简称《报告》)披露,在对全国27个省会城市食品药监管理部门的网站,关于食品召回信息透明度的观测评估显示:27个省会市局全部为零,也就是说,27个省会城市的食品药品监管部门没有一家披露当地的食品召回情况。


  动态监管信息披露全部不及格


  据《报告》负责人、北京大学法学院院长助理李媛媛介绍,此次观察对象共59个,包括国家食品药品监督管理总局、全国31个省级食品药品监管局和27个省会城市食品药品监管局。


  根据《报告》调查结果显示:那些涉及食品安全风险警示、食品召回、食品安全抽检、违法查处和行政处罚等监管活动一线的信息,最值得普通消费者关注,而且也最应该及时、高效地公开和传播。


  负责此次《报告》发布的北京大学法学院博士后、牛津大学法学博士彭钅享向记者介绍:“所谓辟谣要比谣言跑得快,对于上述这些信息的披露也最紧迫。”然而,我国食药监管部门在这方面表现是“重完成时,轻进行时”——食品安全监管动态信息公开是整个测评项目中得分最低的“重灾区”。国家食药总局得分率为46.55%,省、市食药局平均得分率仅为38.45%。

  关于食品召回,2015年10月1日起施行的新食品安全法第六十三条规定:“国家建立食品召回制度。食品生产者发现其生产的食品不符合食品安全标准或者有证据证明可能危害人体健康的,应当立即停止生产,召回已经上市销售的食品,通知相关生产经营者和消费者,并记录召回和通知情况。”


  虽然该条文将召回信息公开的义务放在食品生产者身上,但这并不意味着食药监部门公开此类信息没有规范依据。2015年9月30日发布的《食品药品监管总局关于贯彻落实〈食品召回管理办法〉的实施意见》指出:“(三)统一发布召回信息。省市级食品药品监管部门负责管理本行政区域内食品生产经营者的召回信息发布。总局、省局要在网站上设置专门栏目,统一发布食品召回信息,省市级食品药品监管部门要督促省市级食品药品监管部门网站和基层食品药品监管部门认真核实需要发布的食品召回信息;省市级食品药品监管部门网站食品召回信息要统一链接到总局网站。”


  仅青海每月风险警示超过一次


  根据新食品安全法第二十二条规定,对经综合分析表明可能具有较高程度安全风险的食品,县级以上食药部门应当及时提出食品安全风险警示。


  但是彭钅享向记者介绍,他们的观测团队通过对2014年10月1日至2015年10月1日之间发布的食品安全风险警示进行了统计,发现对于食品的基本情况介绍、风险情况、如何避免风险三方面内容,国家总局都有详细公布,但总体发布次数略少,共10次,每月不到1次。而青海省食品药品监督管理局在同一期间内发布了《关于预防织纹螺食物中毒的风险警示》《关于预防菜豆食物中毒的风险警示》等10次食品安全风险警示信息,平均每月发布的食品安全风险警示超过了1次,是此项上唯一满分的观察对象。


  食品召回信息公开的具体要求则规定在2015年9月1日开始生效的《食品召回管理办法》第十五条:“食品召回公告应当包括下列内容:(一)食品生产者的名称、住所、法定代表人、具体负责人、联系电话、电子邮箱等;(二)食品名称、商标、规格、生产日期、批次等;(三)召回原因、等级、起止日期、区域范围;(四)相关食品生产经营者的义务和消费者退货及赔偿的流程”。


  《报告》为此指出,我国的食品召回信息制度还处在初始阶段,而关于食品召回的信息披露制度也仅仅停留在纸面。
