不过，目前我国刑事立法和司法解释中尚没有关于惩治网络虚假交易行为的专门或者明确的规定。另外，司法机关在办理此类案件时存在争议，法律适用亟待统一。例如，对于组织买卖双方从事虚假网络交易行为并从中牟利的平台经营者，有的司法机关认为应以非法经营罪定罪量刑，有的司法机关则认为不构成非法经营罪。中国社会科学院法学研究所研究员刘仁文认为，炒信平台以营利为目的，利用专业软件将商品或服务的虚假交易信息有偿发布在电商平台的某些店铺。专业从事虚假交易服务的炒信平台，其发布的与虚假交易相关的信息与《关于办理利用信息网络实施诽谤等刑事案例适用法律若干问题的解释》（以下简称《解释》）中的“虚假信息”具有同质性，且主观方面也为“明知”。因此，他建议可以直接适用《解释》第7条，以实现对专业从事虚假交易服务的炒信平台的刑事规制。
据阿里内部人士透露，马云曾在内部会议中将炒信定义为三大“毒瘤”之一，要求零容忍，“不管是否会影响销量，只要是黑的，就要斗争到底”。但是这个道路显然注定是漫长的，法律的完善、对刷单产业链的严打只是其一，整个电商行业包括卖家需要从根本意识到刷单之祸不根除，终将反噬以评价为信任基础的线上交易体系。
