食药监总局发布“非法经营疫苗案查处有关事项通告”

　　总局关于非法经营疫苗案件查处工作有关事项的通告（2016第62号）

　　山东省食品药品监督管理局公布了非法经营疫苗案涉案嫌疑人员名单。为彻底查清涉案疫苗来源、流向，严惩违法犯罪行为，现将有关事项通告如下：

　　一、依据《中华人民共和国刑法》《中华人民共和国药品管理法》等法律法规的规定，不具备疫苗经营资质而经营疫苗，是违法犯罪行为，依法最高可处五年以上有期徒刑；明知他人不具备合法经营资质、仍提供疫苗的，依法可作为共同犯罪，追究刑事责任。山东省食品药品监督管理局公布的涉案嫌疑人员，应在2016年3月23日前向所在地县级以上食品药品监管部门或公安机关主动报告违法经营疫苗情况，包括疫苗的品种、来源、去向等。逾期不报告的，依法从严惩处。

　　二、各药品生产经营使用单位要立即开展自查，凡与涉案嫌疑人员有过疫苗交易或存在从非法渠道购入疫苗、向个人销售疫苗情形的，应在2016年3月25日前主动向当地食品药品监管部门或公安机关报告。

　　向个人销售疫苗的，应报告销售的品种、数量、标示生产企业名称、批号、销售去向、销售时间等；从非法渠道购入疫苗的，应报告来源以及购入疫苗的品种、数量、标示生产企业名称、批号、购入时间等；已经使用或继续销售的，还应报告使用或销售的详细情况。

　　三、地方各级食品药品监管部门要密切关注山东省公布的本地区涉案嫌疑人员名单和协查线索，会同公安机关立案调查，尽快核实涉案嫌疑人身份，及时查明疫苗非法购销情况。对向庞某销售疫苗的线索，要查明销售单位和人员，及销售的品种、数量等；对从庞某购进疫苗的线索，要查明购进单位和人员，及购进的品种、数量等。对医疗卫生机构购入、使用涉案疫苗以及相关人员涉案的线索，要及时通报当地卫生计生部门，以便查明最终销售去向及使用人员情况。上述调查情况，要逐级向上级食品药品监管部门报告，并及时向社会公布。

　　四、公众如了解掌握涉案嫌疑人员情况，可拨打投诉举报电话12331向食品药品监管部门举报，也可向当地公安机关反映。
