　　新华社郑州3月19日专电 (记者李亚楠)记者19日从河南省新野县人民法院获悉，该院近日审结一起组织考试作弊案，6名犯罪嫌疑人分别被以组织考试作弊罪，判处有期徒刑8个月，并处罚金5000元。这是2015年11月1日《刑法修正案(九)》正式实施以来，河南省首次适用组织考试作弊罪。

　　法院审理查明，2015年6月份，新野县人民政府向社会发布公告，公开招聘一批事业单位工作人员。为牟取不正当利益，张某等人在招聘报名现场， 向前来报名的考生索要联系方式，并以中信教育名义为甲方，考生为乙方，先后与40名考生签订了考后付款、考试包过协议，收费分别为8000元至5万元不等。

　　在笔试考试前，张某通过网上发布招聘兼职信息的方式，招募赵某等5人，为实施考试作弊进行任务分工，由赵某、樊某负责，向考生发放作弊工具并教其如何使用。在考试进行当天，该案案发，6名犯罪嫌疑人被公安机关陆续抓获。

　　新野县人民法院审理后认为，被告人张某等6人在法律规定的国家考试中组织考生作弊，其行为均已构成组织考试作弊罪，均应依法受到惩罚，遂根据刑法等相关规定，作出上述判决。(完)
