  在刚结束不久的全国两会记者会上,交通运输部部长杨传堂曾表示,现在,有的城市打车难、行业服务质量不高、人民群众多层次出行的需求得不到有效满足,行业不稳定的问题有时也较为突出,这些都需要对出租汽车管理体制进行改革。


  被废管理办法中包含份子钱的内容


  被废止的管理办法对出租汽车经营企业所具备的资质、出租汽车驾驶员的具体条件、申请从事出租汽车经营事业的程序、文件规范等作了相应规定。随着城市交通拥堵的加剧和公共出行方式的发展,近几年,这项管理办法中的一些具体规定,也引发了不少争议。其中,关于“城市的出租汽车经营权可以实行有偿出让和转让”,以及老百姓口中俗称的“份子钱”,最为出租车司机所诟病。


  另外,管理办法中,只规定“出租汽车实行扬手招车、预约订车和站点租乘等客运服务方式”,也已经涵盖不了近两年新近流行的网络约车方式。


  为何是住建部和公安部发文?


  中国住房和城乡建设部网站21日发布《住房城乡建设部公安部关于废止的决定》。据了解,该决定已经由住房城乡建设部常务会议、公安部部长办公会议审议通过,并于3月16日发布并施行。文件末尾有住建部部长陈政高和公安部部长郭声琨的名字。


  看到住建部和公安部联合发布这一条文,很多人可能会纳闷,出租汽车的管理不是属于交通运输部吗?怎么需要住建部和公安部发文。其实,被废止的《城市出租汽车管理办法》自1998年2月1日起施行,至今已有18年。作为政府大部制改革的一项,交通运输部于2008年3月23日在北京建国门内大街11号挂牌。在此之后,原来由建设部指导的城市客运职责,整合划入交通运输部。因此,在制定这一办法时,指导出租车发展方面的职能属于建设部(当时还不叫住建部,住建部也是2008年大部制改革的产物),直到2008年才划归交通运输部。


  交通运输部已预热出租车管理改革


  在刚结束不久的全国两会记者会上,交通部部长杨传堂曾表示,打车难等问题都要求对出租汽车管理体制进行改革,而在本轮对出租车行业的改革中,将改革经营权的管理,实行经营权期限制和无偿使用,不得炒卖和擅自转让。构建包括巡游出租汽车和预约出租汽车的多样化服务体系。同时,改革“份子钱”的制度,由过去的政府调控改为由企业或者行业协会与驾驶员或工会组织来平等协商,并鼓励、利用互联网技术来构建企业与驾驶员的利益分配。一些地方如浙江义乌等实际上已经取消了出租车的份子钱。


  针对网络约车,中国官方要求在现行的法律框架下,对网络约车经营者、驾驶员和车辆实行许可管理;规范网络约车的经营行为;并建立多部门联合的监管机制,加强事中事后监管。


  业内称废除旧办法为改革铺路


  值得注意的是,在交通运输部已经公布的2016年工作计划中,出租汽车经营服务管理规定(修正案)已被列入因改革要求需以修正案形式修改的规章之中。


  业内认为,废止过时的旧规定,可能是为出租车改革铺路,让出租车司机头疼的“份子钱”、出租车经营权的地域限制等有望出现调整,而民间呼声很高的互联网约租车(专车、快车等)或将迎来合法落地和统一的行业规范。同时,旧规定的废止也意味着出租车改革和网约车管理两个新文件即将出台实施。“先废止已不适应形势的旧规章,说明两个新文件出台的时间已经不远了。”长期关注专车管理的中国政法大学传播法研究中心研究员朱巍说。


  对于普通人来说,新办法出台之后,无论是网络约车还是出租车,在管理上都会更加规范,减少出行的灰色地带。
