环滇池生态区实施定期封闭轮休，滇池湿地公园应对公众开放，应合理确定滇池垂钓区，随意放生将被罚款……近日，市政府常务会审议并原则通过了《昆明市环滇池生态区保护规定(草案)》(以下简称《规定》)，对环滇池生态区的范围、保护原则、建管开放等方面进行明确和规范。
环滇池生态建设是滇池保护治理“六大工程”之一，自2009年以来，通过湿地恢复、生态景观林建设、防浪堤拆除，形成了控制污染物进入湖泊的最后一道截污屏障，构建了环滇池生态区，对逐步恢复湖泊生态系统的良性循环、有效削减滇池面源污染起着举足轻重的作用。此外，环滇池生态建设还极大地增加了滇池湖岸带的景观层次，其生态功能、景观功能、环境功能、旅游休闲服务功能逐步显现。
“环滇池生态区的自然生态属性决定了其最为核心的内容是保护，包括水质改善、湿地、湿地公园、林带保护、生物多样性恢复、人文历史风貌等多方位的保护。”市滇管局相关负责人介绍，加强滇池湖滨生态的保护和管理，保护来之不易的生态建设成果，同时解决滇池湖滨生态建设、管理过程中存在的问题，是制定本规定的目的。
《规定》共29条，明确了环滇池生态区的范围、保护原则、政府及有关部门应履行的职责，对环滇池生态区规划、建设、管理与开发利用等方面进行重点规范。《规定》明确：环滇池生态区是指滇池一级保护区和环湖路临湖一侧以内的滇池二级保护区中的禁止建设区，实行市级统筹、属地管理，全社会共同参与的管理体制。
市、县区政府、管委会应当加大环滇池生态区保护的经费投入，建立多层次、多渠道、多元化的投入机制，鼓励和引导社会资本以独资、合资、合作、特许经营、项目融资等形式参与环滇池生态区的保护工作。鼓励单位和个人以捐资、志愿服务等方式参与环滇池生态区保护工作。市滇池行政管理部门对环滇池生态区保护实施统一监督管理。
《规定》要求，在收储环滇池生态区周边土地时，应按基础设施配建原则，将环滇池生态区土地相关费用纳入土地储备及土地一级开发成本。确定了环滇池生态区的公共性，即不论建设主体是谁，建成的湿地公园及有条件的自然湿地应当对公众开放，不得设为私家领地。依据生态区生态容量和生态平衡需要，由市滇池行政管理部门对环滇池生态区实施定期封闭、轮休措施。
针对市民关注的放生和垂钓行为，《规定》明确，市滇池行政管理部门应当合理确定休闲垂钓、动物放生区域，并采取有效措施，对上述行为进行规范管理。除此区域外，禁止休闲垂钓、放生动物。
对于违反规定，擅自移动或者损毁环滇池生态区的标识和保护设施的，处以2000元以上10000元以下的罚款；造成损失的，应当依法予以赔偿。在环滇池生态区指定区域外放生动物的，处以200元以上1000元以下罚款。在环滇池生态区内野炊、损坏花木，倾倒污水污物、乱扔垃圾等破坏生态环境的，由滇池行政管理部门责令改正，拒不改正的，处以50元以上200元以下的罚款；造成损失的，应当依法予以赔偿。
