昆明出台新规严控基层贿选
中青在线昆明3月27日电(中国青年报·中青在线记者张文凌)“送你一只皮鞋，等我选上后，再把另一只送给你”、“给跳广场舞的大妈每人置办一身新衣，到时候都投我一票”。目前，各地进入基层“两委”换届选举时期，针对五花八门、改头换面、更新换代的基层贿选，云南省昆明市市委组织部日前下发通知，明确了基层选举中不可触碰的“9种情形”，加大对贿选的查处打击力度，严肃选风选纪。
据了解,目前我国的相关法律，对贿选行为的处理，主要是取消候选人资格和宣布当选无效，党内进行纪律处分等，对拉票贿选的表现形式、构成要件、形成结果等没有具体规定。
目前，地方基层拉票贿选花样百出。比如，选举前，有的候选人会争相“帮扶”:一条烟、一桶油，200元钱，送到困难群众家;有的人拿出10万元，表态只要自己选上，这笔钱就捐给村里，分给村民;有的用集体资产给村民买保险，有的将电脑、桌椅等集体资产分发给村民，还挨家挨户送去;有的给工作人员送现金，要求他们在选票统计上“帮帮忙”。
“‘村官’虽小，权力不小，特别是在城中村改造的村改居社区。”昆明市一位组织部门的负责人指出，贿选具有隐蔽性,取证很难,面对法律法规惩戒和道德舆论的压力，贿选拉票人一般不会自己承认;而且我国乡村社会是熟人社会，出于乡缘、亲缘、血缘等现实因素考虑，收受贿赂的村民也基本不会指证。由于现实生活中情况比较复杂,对拉票贿选的行为的难以定性,即使定了性,有的也不易作出裁量和处理。
针对村(社区)选举贿选认定标准模糊的问题，昆明日前出台《关于严肃村(社区)“两委”换届纪律保证换届风情气正的通知》中，明确了9种行为属于贿选：
向选举人赠送现金、存单、银行卡、会员卡、有价证券、支付凭证或实物;为选举人提供吃请、旅游、休闲、健身、娱乐等消费活动;以慰问、帮扶名义向选举人赠送财物;以交保证金形式，许诺当选后将保证金分发给选举人;以许诺当选后赞助村级组织或群众团体活动经费、免除村民债务、给予选举人其他利益或好处等;分发集体资产、用集体资金为选举人交纳各种费用进行拉票;向其他竞选人送钱送物或给予某种利益，让其退出选举;以贿赂等手段诱使或收买选举工作人员在选举中进行舞弊;利用其他手段进行贿选的。
此外，《通知》还明确界定了贿选的实施主体、实施对象、时间等，以及对贿选行为的处理方式，情节严重的,将追究法律责任。
“对涉及贿选的人和事,露头就打,严格执纪，绝不姑息迁就，从而保障群众的民主选举权利。”昆明市委组织部相关负责人表示。（编辑：王亦君）
