《中国经营报》记者调查发现，马茂根曾与龚爱爱、陕北煤老板訾凤高合作“拿下”常乐堡煤矿，更一度介入陕北波罗井田煤矿、青海天峻木里聚乎更煤矿等多个煤田。多位陕北煤田争斗当事人将马茂根描述为缔造“奇迹”者。
而在“追猎者”夏琼看来，马茂根仅有娴熟的手段却无任何可信的身份。夏琼自2005年起，被马茂根以投资“哈佛龙岗分校”等名义拿走近2000万元，至今仍在追索，2012年深圳警方一度对马进行通缉。
现在已是香港人的马茂根，极少再回大陆，不过2016年3月在港的一次开庭中，马茂根承认自己还有另一个名字——马社海，后者则是一起雇凶杀人案中的涉案人员，曾被羁押四年。
广东警方则在2014年出具文件称，马茂根曾威胁、恐吓民警帮其违规办理多个身份证。

夏琼也曾好奇当时马茂根这么有派头的请自己吃饭时，为何只花一两百元，这显然与其身份不匹配。“现在来看，那时候他刚出来，肯定没钱嘛。”
彼时，夏琼手头颇有闲钱，而马茂根则随后带着“某领导的孩子”出现在夏琼面前，让她投资一个即将落户中国的“黄金项目”——哈佛龙岗分校。
“就是说拿地，所以我陆续给他钱，之后又说这个项目不好运作，陕西有个地产项目，可以运作。”马茂根在2008年之后即极少出现在夏琼视野中，夏琼在发现被骗后，随即开始追讨资金。
本报记者则核实，西安地产项目中，马茂根介入后，一开发商被判刑，该开发商至今仍在申诉。而此后马茂根则介入多个陕北煤田争夺，多位陕北煤炭人士证实，马对外自称出生在广东，入伍后成为某办人员，现在则是“首长代理人”。
“有一次我追到西安，他在香格里拉差点把我用枕头捂死，但回头又说因为我来闹事，搞得他的合作对象对他不满，要我不要闹，说会给我钱。”夏琼说直到陕西地产项目被转卖，马茂根仍未给钱，于是他报警。
立案后，马茂根在2012年被通缉，但马在广东省某部门人士陪同下自首三天后，即取保离开，随后赴港。
有律师、媒体人先后曾前往马茂根的出生地河北省邯郸市魏县双井镇北照河村探访，从村支书、派出所证实，马茂根系村民马少锋三子一女中的第三子，从未入伍，且正是涉入郑金木雇凶杀人案的“马社海”，生于1971年。
“我们去的时候户籍信息都没变化，但我们查过后不久，有人找到当地派出所，将马社海这一原始户籍信息全部注销。”夏琼提供的证据显示，前述扮演“某领导子 女”的两名人士，在接受警方问询时，承认其曾在2005年通过马茂根在广东某派出所办理假身份证，而某派出所出示的证明显示，“马茂根”这一身份，即该所 民警遭马茂根胁迫后违法办理，系假身份。

马茂根在与高海燕签订协议不久后，即又将常乐堡煤田控股企业转卖给陕北煤老板訾凤高、龚爱爱等人。訾凤高曾向媒体证实他们给马茂根的近亿元仅仅是整个交易对价的零头。
不过，由于纠纷难解，马茂根将常乐堡煤矿转给龚爱爱迄今无法兑现。而此前媒体报道，马茂根曾在龚爱爱出事后，宣称可以帮其“摆平”，龚爱爱后仅被追究证件造假，并未对媒体指责的其他涉嫌犯罪问题予以追究。于2015年服刑期满出狱。
“我打听到的是几十亿，而且部分钱是从常乐堡煤矿转出又到了其他公司。“高海燕调取的银行流水证实了这一说法。

2012年后，马茂根在夏琼的“追猎”中成功以马茂根这一身份，借赴港照顾母亲为由成功办理赴港单行证，移民香港。不过，在今年3月与高海燕在香港法院对簿公堂时，马茂根承认赴港实际为照顾干妈王某某，而王某某则是其名下企业代理律师。
夏琼借此向广东、香港两地举报马茂根身份造假及违法移民。此后，广东公安系统某人员找到她，希望代马茂根协商赔款问题。此外，2014年，广东东源县公安 局曾向夏琼出具文件称，马茂根通过当地公安人员违规办理了王世有、王世友等身份，并为他人办理甘宴宾、钱诗如等身份。
《中国经营报》记者查询发现，马茂根在香港注册有秦皇集团有限公司、 中国北方医疗科技有限公司、香港秦皇电影有限公司、冀特长江集团有限公司、北方黄埔集团有限公司、秦皇冀安集团有限公司、陆港民生农副产品有限公司、香港 重地（集团）有限公司、香港神龙开元集团有限公司等企业。
在深圳，马茂根名下则拥有一家名为“元帅府”的企业，在北京则注册了北京冀特影视传媒有限公司，该公司监事为马茂轩亦为假身份，而注册地则与龚爱爱、王鲜的一家企业一致。
