  上海市政府新闻发布会昨天上午10点举行,发布了《关于进一步完善本市住房市场体系和保障体系 促进房地产市场平稳健康发展的若干意见》(以下简称《若干 意见》),其中限购和信贷政策升级成为本轮调控的“利器”:非本市户籍居民家庭购房需连续缴纳个税及社保年限从2年变为5年;从紧实行差别化住房信贷政 策,对拥有1套住房的居民家庭,购买非普通自住房的,首付款比例不低于70%……

  [非本市户籍]


  购房需缴税缴社保满5年


  《若干意见》 要求从严执行住房限购政策,非本市户籍居民家庭购房缴纳个人所得税和社保的年限,从自购房之日起计算的前3年内在本市累计缴纳2年以上,调整为自购房之日前连续缴纳满5年及以上。


  这项规定影响了部分连续缴纳个税、社保处在2-5年间的计划购房者。能不能把个税和社保补缴到5年?对此,上海市住房城乡建设管理委主任顾金山表示,政策规定是自购房之日前连续缴纳满5年及以上,主要是由相关社会管理部门查录信息为准,补缴行为不符合政策。


  顾金山表示,对于延长限购年限的问题,主要是考虑上海的住房发展原则,是坚持以居住为主、以市民为主、以普通商品住房为主。这次是根据中央对全国房地产 市场因城施策的管理要求,四个一线城市要根据实际情况,尤其是特大型城市当中,综合考虑人口、交通、规划、环境管理等要求,以及房地产市场本身的可持续发 展等方面因素,因城施策进行管理。从上海实际出发,这次加强了房地产调控力度,将原来前3年内在本市累计缴纳2年以上,调整为自购房之日起连续缴纳5年以 上,最起码5年居住、5年稳定就业。对于在本市有合法稳定工作常住人口的阶段性住房困难,特别是青年职工、引进人才等“新上海人”,将加快构建多层次、全 覆盖的住房供应体系,主要是通过公共租赁住房等来解决他们在过渡阶段的住房困难问题。


  [企业购商品住房]

  《若干意见》规定,企业购买的商品住房再次上市交易,需满3年及以上,若其交易对象为个人,按照本市限购政策执行。同时,为进一步规范交易行为,限购审核将前置至交易备案环节。这两项政策针对此前一些限购人群通过政策漏洞违规炒房的情况。


  据悉,此前沪上有一些限购人群通过种种方法规避限购:如一次性付款等方法与房企达成协议,只签合同而不去办理房产证登记,随着房价上涨,当他们转手卖房时,只需在房企进行合同更名。还有的人注册公司,以公司买房的形式办理房产证登记手续。


  [二套房认定]


  坚持“认房不认贷”原则


  《若干意见》强调从紧实行差别化住房信贷政策,加强个人住房贷款管理。对拥有1套住房的居民家庭,为改善居住条件再次申请商业性个人住房贷款购买普通自住房的,首付款比例不低于50%;购买非普通自住房的,首付款比例不低于70%


  在解释有关房地产信贷政策时,市住建委负责人强调将坚持“认房不认贷”原则,严格实施差别化住房信贷政策。凡目前在房地产交易系统内查询到已拥有1套住 房的,无论其是否有贷款记录、无论其住房贷款是否结清,均执行差别化信贷政策,即购买第二套普通自住房的,首付款比例不低于50%;购买非普通自住房的, 首付款比例不低于70%。目前没有住房的,还是实行首套房政策。


  《若干意见》还规定,购房人在申请贷款时还应承诺首付款为自有资金,违反承诺则作为失信行为信息纳入本市公共信用信息服务平台。此前,部分购房者通过申请首付贷甚至消费贷的方式来凑足首付款,杠杆买房扩大了金融风险,一旦遭遇楼市调整容易产生坏账。


  [新政何时实施]


  即日起实施,以网签为准


  据悉,《若干意见》已经市政府常务会议审议通过,从即日起发布实施。


  很多正在进行的房产交易以何为节点?顾金山表示,从即日起,就是以网签时间为准。由于前天交易量较大,特别是下午交易比较集中,造成新建商品房合同备案系统运行不畅,有关方面立即采取了措施,将原21时结束的网签时间调整延长至24时。


  前天,上海房产交易突然出现高峰。来自上海网上房地产的交易数据,3月24日19点,上海一手房成交量突破了1100套,到晚上9:08,已经超过1360套,一度导致网签系统发生故障。而今年3月以来,上海日均交易533套,而去年同期为170套。
