　　昨日上午9时，该案在海南省高级人民法院进行听证会。新京报记者从王万琼律师处了解到，听证会在上午已结束，当事双方在赔偿事宜上仍有争议。

　　海南高院院长曾表态依法赔偿

　　1992年12月25日夜，海口市上坡下村109号发生一起杀人放火案，46岁的物管人员钟某某遇害。案发后，曾在此租住过的陈满被锁定为凶手，后被羁押、逮捕。1994年11月22日，陈满被判死缓。

　　从1992年12月底被捕，至今年2月1日洗冤，陈满共失去自由超过23年，共计8437天，是国内已知服刑时间最长的蒙冤者。

　　今年3月14日，陈满代理律师王万琼赶赴海口，代表陈满向海南高院提出国家赔偿申请，海南高院决定予以受理。3月22日，海南高院决定3月30日对陈满申请赔偿案进行听证。

　　此前，3月13日下午，十二届全国人大四次会议海南团审议“两高”报告间隙，列席会议的海南省高院院长董治良就陈满案首度作出回应称，陈满案纠错，是国 家法制的进步。待收到国家赔偿申请书后，高院将依据国家赔偿法，组织合议庭审理之后，“该怎么赔依法来裁断、依法来赔。”

　　申请误工费为职工年均工资的2倍

　　王万琼向新京报记者出具的国家赔偿申请书显示，除要求赔偿义务机关在中央电视台、《人民日报》、新华网等多家媒体公开赔礼道歉、消除影响外，还要求海南 高院赔偿人民币9661332.92元。其中含侵犯人身自由赔偿金1853777.64元；误工费3707555.28元；医疗费、后续治疗费10万元； 精神损害抚慰金300万元，以及赔偿23年申冤的费用支出计100万元。

　　申请书称，陈满被剥夺人身自由时，就已经开办了一家装修公司并初具起色，其工资水平远远超过普通职工，以2015年最高人民法院公布的职工日平均工资为基数，请求人的误工费按照普通职工年平均工资的2倍计算。

　　此外，陈满未被羁押前身体健康，今年2月2日，经四川省人民医院的全身检查，陈满被查出患上了严重的胃溃疡、肛裂及双下肢体麻木，需要后续长期治疗，请求赔偿义务机关承担医疗费及后续治疗费。

　　同时，请求人还提交了医疗机构的诊断证明、鉴定意见、申冤费用开支凭据等作为证据支持。

　　昨日中午，王万琼告诉新京报记者，听证会上，赔偿委员会5人出席，还有案件承办法官和书记员出席，并邀请了当地政协、人大代表旁听。听证会上主要听取了 陈满就赔偿提出的意见和要求，“主要还是一些争议，比如此前已经鞠躬致歉，消除影响，现在是否还需书面道歉，另外在精神赔偿费和误工费赔偿款项上还有一些争议。”

　　陈满：我们提前到的，不到九点钟。

　　新京报：海南高院副院长此前已鞠躬致歉，你还提出了书面致歉的要求。

　　陈满：当时我认为他不是给我办案的人，觉得没有必要。但是我受了23年的冤屈，冤案对我造成了损失，书面致歉是应该做的。仅要求书面致歉和消除影响，这是非常合理的，也是最低的要求。

　　陈满：很陌生，现在刚开始用手机，刚学会一点，还有很多都是人家教一点学一点。和社会隔绝了这么多年，连电脑都不会，连生存技能都没有。

　　新京报：现在空闲下来都在做什么？

　　陈满：看看电视，读读书，像马云、李嘉诚的传记，还有《论语》。现在肯定要进行调养，我要适应社会，还有很多事情要去做啊。对于生存起码要有培训过程，这个还需要时间的，可能还要一年。

　　新京报：之前想做的事情呢？

　　陈满：当时最想做的事情就是陪伴父母，孝敬父母。他们本来应该安度晚年、颐养天年的，却为我受苦受难。父母80多岁了，他们付出太多了，我父亲今天（30日）还去医院输液了，现在说实在的，他们也没从阴影中走出来吧，不是那么简单的事情。

　　新京报：阴影很深吗？

　　陈满：那肯定啊，阴影很难抹去的，对我们来说都是一生的痛苦，只能调节缓解。
