不过对邮政、快递行业则“留有余地”，规定可使用符合快递专用电动三轮车国家标准的电动三轮车在规定区域内从事社区配送服务。
据了解，本次只是第一次审议，接下来还有二审，不排除会有修改。
举措1：禁售全市范围内禁止销售电动车
广州市法制办主任邢翔介绍，草案主要亮点是针对摩托车和非机动车(主要指残疾人轮椅车、电动自行车、人力三轮车)创设了“禁售”、“禁油”、“禁行”、“禁停”及“禁营运”等管理制度。
记者了解到，“禁油”等此前在市政府相关文件中均有提及，但“禁售”则是广州首次提出。
据广州市政府提交的草案，广州拟在全市行政区域内禁止销售电动自行车，在本市禁止摩托车通行范围内禁止销售摩托车。在越秀区、海珠区、荔湾区、天河区、白云区、黄埔区范围内禁止销售人力三轮车。残疾人机动轮椅车由市残联统一发售，其他任何单位和个人禁止销售。
据了解，目前各地对电动车管理普遍的做法是，禁止超标(重量超过40公斤，时速超过20公里)的电动车上路，但对在国家标准范围之内的则未禁止上路和销售。
草案还为电动车等非机动车和摩托车销售者设定了“告知义务”，即应当在销售场所显著位置张贴本市有关摩托车、电动自行车、人力三轮车等禁止上道路行驶、销售的告示，并向购买者告知本市有关摩托车、电动自行车、人力三轮车等车辆禁止通行、销售的规定。销售者未履行告知义务，导致购买者购买的车辆无法上道路行驶的，购买者可以依法要求退货。
违反前述规定，在本市禁售区域内销售电动自行车和摩托车，违规销售残疾人机动轮椅车的，由工商管理部门责令改正，并处违法销售车辆每辆2000元罚款；无法查清销售数量的，处1万元以上5万元以下罚款。
非机动车和摩托车的销售者未在销售场所显著位置张贴政府部门有关告示的，由工商部门处3000元以下罚款。拒不退货的，由工商部门按照《消费者权益保护法》相关规定处理。
举措2：禁油给外地牌摩托车加油最高罚3万元
草案的文字说明称，目前广州市区道路上出现的非机动车和摩托车，70%以上均为外市籍、无牌无证的非法车辆。
对此，草案规定，本市行政区域内的加油站禁止向未悬挂号牌或者悬挂外地号牌的摩托车、残疾人机动轮椅车以及禁止上路的其他车辆供油。
本市摩托车限行范围内的加油站禁止向摩托车、加装燃油动力装置的人力车及燃油助力自行车等车辆供油(军、警用摩托车除外)。
违反规定的，由工业和信息化行政管理部门处以警告；情节严重的，责令停业整顿，并处以1万元以上3万元以下罚款。
举措3：禁营运按规定小区内也不允许电动车通行
草案规定，广州市行政区域内禁止下列车辆上道路行驶：㈠电动自行车和其他安装有动力装置的非机动车(不含本市号牌的残疾人机动轮椅车)；㈡未在本市登记的残疾人机动轮椅车、摩托车；㈢拼装、加装、改装的非机动车和摩托车；㈣畜力车；㈤本市禁止上道路行驶的其他非机动车。同时，除专业批发市场范围内运货需要以及市政、环卫等单位作业需要外，禁止在越秀区、海珠区、荔湾区、天河区、白云区、黄埔区范围内行驶人力三轮车。
目前在番禺等地大型小区，不少居民购买电动车用于买菜及接送小孩等，此种情况是否也属于禁行范畴？
广州市公安局交警支队副支队长周远帆说，按照道路交通法对道路解释，用于公共车辆通行的也算道路，比如小区内有公交车经过，按照条例草案今后就不允许电动车通行。

草案规定，本市行政区域内的公共停车场不得停放电动自行车，在本市禁止摩托车行驶范围内的公共停车场不得停放摩托车，在本市禁止人力三轮车行驶范围内的公共停车场不得停放人力三轮车。违反规定的，由交通行政管理部门责令改正，并处以5000元以上1万元以下罚款。
