去年一年,北京电动自行车事故3万余起,伤2万多人,闯红灯、逆行现象突出

近一两年来,电动摩托车、电动自行车在部分城市被限制。近日,广州拟出台的非机动车和摩托车管理条例也进入了人大常委会审议程序,全国首部针对电动自行车、电动三轮车的法规即将出台。

草案明确,广州拟对电动车等非机动车、摩托车实施“五禁”(禁售、禁油、禁行、禁停禁营运),其中对于电动车,首次明确规定,在全市范围内禁止销售,无论其是否符合国家标准,违者按每售一辆处以2000元或者最高5万元的罚款。

从草案可以看出,禁限内容主要是针对广受诟病的电动自行车交通违法乱象以及电动三轮车违规揽客运营。

这些情况在全国大部分地区也多有存在,在北京,电动自行车保有量已经超过400万辆,根据交管部门的统计,去年一年,电动自行车发生的事故3万余起,伤2万多人,100多人死亡。违法现象最突出的是闯红灯、逆行、无牌无证驾驶。

针对电动自行车乱象,全国已经有多地采取了限制措施。成都2014年实施非机动车管理条例,随后全市开展电动自行车上牌工作,五个多月上牌200多万辆。武汉也出台电动自行车暂行管理办法,规范电动自行车的驾驶。贵阳市去年底,针对电动自行车交通违法乱象,出台了分阶段分路段限行规定,电动自行车在高峰时段不允许进入多条主要道路行驶。

深圳方面进行此次严查正是为了解决积怨已久的交通难题。深圳方面公布的数据显示,去年全市共发生道路交通事故1150宗,同比下降3.5%,死亡431人,同比下降6.1%,但涉摩涉电交通事故死亡人数为41人,同比上升27.66%。

中国自行车协会助力车专业委员会主任陆金龙也关注到了近期发生在深圳等地的查扣电动车事件,他认为,电动车的管理亟待法律和国家标准的支持,不应该将超标电动车的危害以及部分驾驶人的违法行为全部归罪于电动车行业。

陆金龙介绍,目前全国有电动车用户2亿,电动助力车行业的GDP贡献每年是2000亿,带动了200万人的就业。但电动车的发展并没有配套的管理办法和国家标准跟上,他说,目前执行的还是1999年的国家标准,对电动自行车的标准是20公里内,40公斤以内,这个标准显然已经不符合电动车技术的发展和老百姓的需求。

陆金龙也认为,现行的规定需要调整,他们向工信部、公安部等相关部门提出意见,希望尽快解决国家标准问题。“目前还没有回复,但我们已经着手积极应对各地出现的问题了。”他说,如果大城市出台限制电动车的“一刀切”式的措施,恐怕会引起二线、三线城市的效仿,对全行业会有非常大的打击。

快递电三轮进退两难

在城市管理部门眼里,电动三轮车是制造交通事故的罪魁祸首;在快递企业眼中,它是降低企业成本、提高运营效率最有效的交通工具。

某大型快递企业负责人坦承,电动三轮车(两轮车)与汽车等交通工具相比确实存在极大的安全隐患,无牌照不利于监管部门监督也造成大量违反交通规则事实的出现。不过,电动三轮车的确也是目前快递业最理想的末端派送工具。据业内人士介绍,一辆电动三轮车的日派件量为120-150件,电动两轮车为电动三轮车的一半。

媒体披露,北京每天行驶在街头的电动三轮车就在1.5万-2万辆之间,在全国范围内快递业使用的电动三轮车则超过40万辆,有预测数据显示,市场整体需求超过100万辆。

国务院发展研究中心产业经济研究部研究员、中国物流学会副会长魏际刚认为,“中国的快递业快速发展,快递业使用的主力车型是滞后于快递业发展的。”我国快递发展阶段还是处于多种生产力水平、多元化的形态下,以城村目前的配送体系,电动车这种传统的配送方式还是有存在的必要性的,“关键是要规范使用,而不是从行政方向予以解决。”

“快递电三轮进退两难。公安交通部门没有错,快递企业也有理由。”双壹咨询公司总经理,物流行业调研专家龚福照表示,深圳是国内快递量排名前五的地区,如果不让使用电动三轮车,那也应该给一个缓冲期。

解决“最后一公里”

新京报记者注意到,此前北京、天津、呼和浩特等多个城市都对快递行业的用车进行过规范,但最后落地实施阶段均遭遇阻力。

“管理部门出台措施加强电动自行车管理也是现实情况所迫。”据交通部门一位人士介绍,表面上看是交通乱象丛生,但背后则是管理标准的缺位。“这就是一个历史问题的积累,现在到了矛盾爆发点需要法规约束。”

业内人士认为,解决快递电动三轮车难题最重要是解决快递电动三轮车合法身份问题,即推出快递“专用车”。一是由于快递三轮车来源不明,一些生产厂商自身就未取得相关资质,电动三轮车的合法身份就无从谈起;另一方面是国家相关部门需要制定适合快递业的相关标准,让快递电动三轮车有法可依。

快递用车难题已经引起多方注意。此前,国家邮政局已经推出《快递专用电动三轮车技术要求》,明确了快递三轮车的车型、尺寸、车速等多项指标,但由于该标准并非强制性措施,而未得到各方认可。去年底,国务院发布的《国务院关于促进快递业发展的若干意见》明确指出,将制定快递专用机动车辆系列标准,改进快递车辆管理。

今年初,中国国家标准化管理委员会已经对《快递专用电动三轮车技术要求》标准进行了公示,强制的主要内容包括车速限制、驾驶人员核定、箱体标识等。

根据2015年国务院出台的关于促进快递业发展的意见,其中就提及改进快递车辆管理,并要求制定快递专用机动车辆系列标准,及时发布和修订车辆生产企业和产品公告。各地要规范快递车辆管理,逐步统一标志,对快递专用车辆城市通行和临时停靠作业提供便利。

文件还称,应研究出台快递专用电动三轮车国家标准以及生产、使用、管理规定,各地可结合实际制定快递专用电动三轮车用于城市收投服务的管理办法,解决“最后一公里”通行难问题。

魏际刚建议,解决这一问题应加强对电动三轮车的监督管理,比如上牌照、对电动车上路设置准入条件、必须遵守交通法规行驶、在快递车上装摄像头,对快递人员身份进行登记识别。建立完善的监管体系,根据快递行业的发展变化,提升监管部门的监管能力,改善监管方式,而不是去破坏快递行业的发展。“城市要包容,政策与执法要人性化。”

深圳禁摩限电快递业首当其冲

深圳交警连日高压态势的“禁摩限电”行动逐步引发市民争议,而邮政快递等行业成为首当其冲者,有市民认为此举将打击这些行业的发展。对此,深圳交警昨日表态称,仍会在“禁摩限电”上保持稳定的打击力度。不过,特殊行业在经过登记备案后被允许使用电动自行车上路,同时深圳交警还对这些行业淘汰电动及机动三轮车留出15天的过渡期。
