　　杨先静对权力的痴迷由来已久。2000年，安徽省地矿局与省土地局合并为省国土资源厅，杨先静任副厅长。凭着20年“老地矿”的资历，他将与矿产资源有关的管理权限全部握在自己手中，分管工作涉及矿权勘探、登记、出让、变更、延续等多个环节，几乎占了国土厅职权的半壁江山，可谓“位高权重”。

　　2005年，54岁的杨先静如愿当上了正厅级巡视员，但也意味着再过几年他就要退休了。从那时起，杨先静思想上渐渐发生了变化，开始考虑自己的“后路”问题。一些有求于他的矿业公司老板，进入了他的“朋友圈”。

　　安徽省高级人民法院的判决书显示，杨先静为这些矿老板办事可谓“尽心尽力”，但在办事时几乎从不收受财物，故作一身“清廉”。其实，杨先静对金钱的贪婪不亚于对权力的痴迷，他内心深处是准备“做长线买卖”。正如他所说：“在位时，因我手中的权力，让很多人成为了亿万富翁。退休后，我就千方百计地让他们给我相应回报。”

　　2007至2011年的4年时间里，杨先静3次出手，帮助安徽大昌矿业公司董事长吉立昌先后解决了延续分立、转让、出让铁矿探矿权事宜。在私人老板因之受益的同时，造成的是18.9亿余元国家财产损失。在两人的交往过程中，吉立昌多次表示要送钱物，杨先静虽然一直没有答应，却留下一句话，“等退休了再说”。

　　事后查明，杨先静共收受和索取吉立昌贿赂共计人民币1001.4万元、美元2000元。除了1.4万元人民币和2000美元这个“零头”是其在位期间发生的外，其余均是退休后索要的。

　　办理此案的公诉人指出，杨先静收受或索取的1600余万元贿赂，大部分集中在其退休前后。他通过离职前后连续实施或在离职前约定离职后实施的形式，在即将退休和退休之后的短短半年时间，通过打“时间差”和打借条等方式收受了大量财物。特别是退休后，杨先静根据其在位时为老板提供帮助的大小以及他们获取利益的多少，分别向每人索取少则20万元、多则1000万元的“回报”。殊不知，“投资变现”之时，也是无法回头之日。

　　点评：人未退休，心先脱党，“在位预约、退休受贿”的“期权腐败”，在杨先静身上表现得特别明显。一句“等退休了再说”，充分暴露了杨先静“无利不起早”的贪官本性，和“平安着陆”后再“变现权力”的狡诈心思。杨先静的落网再次警示，党员领导干部只有时刻“心有所畏、言有所戒、行有所止”，才能敬终如始，避免晚节不保的悲剧发生。

　　协会兼职发挥“余热”，岗位退休权力未退

　　2011年12月，杨先静正式办理了退休手续。然而，他对权力的贪恋远未停止，仍担任省矿业评估师协会会长一职，并且在这个位置上继续发挥权力的“余热”。

　　省矿业评估师协会由省国土资源厅负责管理，本是非营利性的行业社团组织，不具有审批权。但退休前“说一不二”的杨先静，已将矿权审批的部分事项交由矿业评估师协会办理，为以后继续行使权力铺路。

　　“小国土厅”，是杨先静担任会长期间，一些国土系统干部和矿老板对省矿业评估师协会的别称，协会和杨先静这个会长在他们眼里的重要性可见一斑。“岗位退休了，权力未退休”，是对杨先静的生动写照。

　　对权力握住不放，是因为对利益依依不舍。杨先静退休后，仍有一些人投其所好，送与他大额钱物，这与他担任会长有着很大的关系。对于这一点，杨先静心知肚明，也乐见其成。

　　除依靠协会会长这个头衔敛财，杨先静还利用原职务的影响力，随意插手干预省国土资源厅的业务工作，从中捞取好处。2012年下半年，杨先静向国土厅老部下打招呼，违规追加土地计划指标，帮开发商办理建设用地审批。事成后，杨先静获得“感谢费”30万元。

　　“虽然退休了，但我毕竟在国土厅工作那么多年，退休时间不长，和他们（国土资源厅的同事）关系也不错，他们比较尊重我，相信他们会给我办好的。”正是靠着这种“关系”，杨先静对于矿老板们来说仍有利用价值，这也是吉立昌等人心甘情愿掏钱的原因所在。

　　退休后的杨先静，俨然成为一个唯利是图的商人。他利用制度漏洞和监督盲区，游刃有余地周旋于政府官员和企业老板之间，做着损公肥私的勾当。他不仅未能严格律己，还带坏了与他“关系不错”的下属，污染了整个单位的政治生态和风气。

　　点评：反腐无禁区、全覆盖、零容忍，党纪面前没有例外，不因职务高低而区别对待，更不因退休与否而放松要求。党员领导干部虽然离开了工作岗位，但党员的标准要求不会变，同样受党章党规党纪的约束。杨先静等案例表明，退休不是“挡箭牌”，绝不能因“船到码头车到站”而放松警惕，必须时刻保持清醒头脑，绷紧纪律之弦，不忘初心，方得始终。

　　以借为名规避调查，机关算尽只落得身败名裂

　　庭审中，杨先静说自己“上当了”。2010年前后，曾有人对他说先打借条再收钱，这样即使查出来也不违法。为掩人耳目，杨先静在收受贿赂的形式上颇费心思，把“索贿”变成所谓的“借贷”、“融资”和“理财”，处心积虑地给自己的违纪违法行为披上“合法外衣”。

　　刚一退休，杨先静就迫不及待地以投资为由，向吉立昌“借款”1000万元。按照杨先静的要求，吉立昌将1000万元转到安徽某公司董事长李某的个人账户上，作为杨在该公司的投资。为逃避调查，杨先静还以其妻名义向吉出具了借条。

　　使用类似伎俩，杨先静以女儿在北京买房为名，又分别向安徽某矿业公司董事长朱某等人“借款”20万至350万元不等。

　　以借为名，让杨先静收钱收得心安理得，觉得不会出什么问题。直到有一天，时任省国土资源厅矿管处处长被司法机关查处，杨担心受到牵连，慌忙四处“归还借款”。十分讽刺的是，对于向吉立昌索要的1000万元，杨先静多次要求吉暂时别动这笔钱，等风声过后还要拿回来，他的贪婪与侥幸暴露得淋漓尽致。

　　以为打几张借条收钱就可以逃脱纪律和法律制裁，岂不知这种行为本身就是掩耳盗铃。借款又退款的一幕幕丑剧，掩盖不了他内心对金钱不可遏止的贪欲，暴露了他对抗组织审查的企图，更改变不了他违纪违法的事实。最终，他落得身败名裂、两手空空。

　　“我已经是63岁的老人了，本来应该安度晚年，享受天伦之乐，可是我没有把握好自己，放纵自己，给国家造成了巨大的损失，也给我的家庭造成了巨大的伤害。”在法庭上，杨先静忍不住痛哭流涕，却为时已晚。

　　点评：有人把贪官借钱比作黄鼠狼借鸡，有借无还，但总有人愿意把钱“借给”这些腐败分子。借钱的背后，实质是公权力在发挥作用，是赤裸裸的权钱交易。杨先静们机关算尽、花样百出，但不论是“期权腐败”之约，还是以借之名受贿，都不可能作为违纪违法的“挡箭牌”，更不可能成为逃避惩罚的“障眼法”，等待他们的只能是纪律和法律的严惩。（记者 李靔 通讯员 陈红星）
