  京华时报讯修地铁本是方便出行的好事,可是最近,安徽合肥翡翠路山水名城小区的居民们却因修地铁而心烦,因为他们得知,有一个地铁出入口将会建在小区里面,会占用一部分公共用地。记者现场采访了几位居民,大家都表示了心中的担忧。


  在山水名城小区,业主告诉记者,半个月之前,突然有一群人自称是地铁施工方的,带着测量工具来到小区开始测量、划线。需要用到小区的绿地,他们来测量的时候,小区业主发现了。


  居民们提到的在小区里正在施工的是合肥地铁3号线。记者从相关主管部门获悉,3号线祁门路站站点的一处出入口,由于附近道路空间有限,所以计划延伸至山水名城小区内,占用一部分公共用地。小区居民表示,经过咨询,他们获悉这个出入口将修在小区1号楼和2号楼之间,按照施工规划,要占用这一块大约180㎡的公共用地,其中包括一个配电站和一些绿地,但施工前小区里没有公示。


  记者随后采访了合肥城市轨道交通有限公司总工办副主任陶治来。陶治来表示,是“部分侵入”小区内部,施工前在《合肥晚报》进行了公示。


  实际上,在居民们看来,家门口有个地铁出入口是方便了,可是建在小区内部,不仅占用了原本属于业主们的公共用地,破坏了小区环境,同时安全也不能保障。业主说,施工会给小区生活带来不便,如果挖深对小区的房屋质量也有影响。


  根据物权法和物业管理条例的规定,如果要改变居住区绿地的使用性质,首先要取得2/3以上业主的同意,其次应该取得业主们的书面确认,并向全体业主进行公示,最后办理完相关审批手续后才可以动工。山水名城小区业主认为,类似这样的情况肯定要走一些程序,业主肯定要知情,而且还要有参与,这些都没有。他们曾和合肥市规划局、合肥市轨道办进行过多次沟通,但到目前为止,没有任何书面材料。


  对于施工程序,陶治来表示,是严格按照国家规定去做的,都是有依据的,该出入口的选址、建设等前期方案均已上报相关主管部门,并已通过相关网站以及在施工现场进行了公示。


  据了解,合肥市轨道办针对小区居民反映的问题,目前正在组织专家进行研究、论证,将在尽最大可能维护小区居民权益的同时,保障轨道工程施工建设的安全顺利开展。在建设过程中,如果确需对小区部分围墙、绿地等设施进行拆除,在施工完成后,轨道工程施工单位都将会予以恢复。 (央广)
