团购网称商家违规

昨日,圣瑞华量贩式KTV工作人员告诉记者,38元的团购券确实以前出过,但上个月就停止销售了,“因为我们下午不接受量贩式KTV的顾客了,营业模式有变,所以不能提供服务”。对于在团购结束前就购买好的券,他表示只能找团购平台退掉。

对于此事,大众点评网回应记者,“商家的做法违规,在有效期内不提供服务属于合同违约,我们会对其进行处罚。”但对于已经购券的消费者,“我们只能给其全额退款,如果有进一步诉求可以协商”。

商家和网站都应担责

北京市竞天公诚律师事务所陈抒律师表示,团购券信息明确,对于服务的具体内容和时间期限都有严格规定,“消费者购买了团购券就已经与商家有了事实合同关系,商家不提供服务属违约行为”。此外,由于消费者是在大众点评网购买的团购券,网站也应承担连带责任。

但对于违约赔偿,陈律师认为商家和平台提出的“退款”就是一种承担违约责任的方式,“如果消费者还能举证该事件对自己造成了其他额外的直接损失,也可向商家和网站追责补偿”。
