Commerce Department on North Korea embargo, partial list of minerals

For the implementation of the relevant UN Security Council resolutions, in accordance with the People's Republic of China foreign trade law, embargo against North Korea to the following products:
, Ban imports from North Korea's coal, iron, iron ore, except in the following two cases:
1. designated solely for livelihood purposes, not involving North Korea's nuclear or ballistic missile programmes or United Nations Security Council the 1718th (2006), the 1874th (2009), No. 2087 (2013), No. 2094 (2013) or No. 2270 (2016), other activities prohibited by revenue-generating transactions.
To import the transaction, subject to customs authorities upon import, submitted by the legal representative or responsible person signature and stamp of the enterprise business undertaking (annex 2). If credible intelligence confirmed that the deal was not for livelihood purposes or in connection with North Korea's nuclear or ballistic missile programs, the Customs authorities shall not be released.
2. confirm not North Korea native, but via North Korea shipped exclusively from Luo Jingang (Rason) exports of coal, and that such transactions do not involve North Korea's nuclear or ballistic missile program or the United Nations Security Council the 1718th (2006), the 1874th (2009), No. 2087 (2013), No. 2094 (2013) or No. 2270 (2016), activities prohibited by the income.
To import the transactions, an enterprise has to advance to the provincial Commerce authorities to provide the relevant information and application, submitted to the Ministry of Foreign Affairs through the Ministry of Commerce from its notification to the United Nations Security Council sanctions Committee after the report, the enterprise may be imported. Import customs declaration must be submitted to the Customs authorities with the legal representative or responsible person signature and stamp of the enterprise business undertaking (annex 3) and the certificate of origin. If credible intelligence confirmed that the trade does not belong to this exception, the Customs authorities shall not be released.
Second, the ban on imports from North Korea the gold ore, Titanium Ore, vanadium and rare earth minerals.
Third, the ban on exports to North Korea in jet fuel, including gasoline, naphtha-type jet fuel, kerosene type jet fuel, kerosene type rocket fuel, but except in the following two cases:
1. the United Nations Security Council sanctions Committee has approved the transfer to North Korea on a case have been verified to meet the basic humanitarian needs of the aviation fuel, subject to the special arrangements for effective monitoring of delivery and usage.
2. outside North Korea's civilian airliner sales or supplies for use of aviation fuel during the flight to and from North Korea.

为执行联合国安理会有关决议，根据《中华人民共和国对外贸易法》，现对朝鲜禁运下列产品：
一、禁止自朝鲜进口煤炭、铁、铁矿石，但下列两种情况除外：
1. 被认定完全是为了民生目的、不涉及朝鲜核计划或弹道导弹计划或联合国安理会第1718（2006）、第1874（2009）、第2087（2013）、第2094（2013）或第2270（2016）号决议禁止的其他活动创收的交易。
进口属上述交易的，须在进口报关时向海关部门，提交经企业法人代表人或负责人签字并加盖企业公章的企业承诺书（附件2）。若据可信情报证实该交易不是为民生目的或与朝鲜核计划或弹道导弹计划有关，海关部门不予放行。
2.证实不是朝鲜原产的、而是经由朝鲜运送的完全是用于从罗津港（Rason）出口的煤，且此类交易不涉及为朝鲜核计划或弹道导弹计划或联合国安理会第1718（2006）、第1874（2009）、第2087（2013）、第2094（2013）或第2270（2016）号决议禁止的活动创收。
进口属上述交易的，企业须事先向所在地省级商务主管部门提供有关信息和申请，经由商务部提交给外交部，由其向联合国安理会制裁委通知报备后，企业方可进口。企业进口报关时需向海关部门提交经企业法人代表人或负责人签字并加盖企业公章的企业承诺书（附件3）和原产地证明。若据可信情报证实该交易不属于此类例外，海关部门不予放行。
二、禁止自朝鲜进口黄金矿、钛矿、钒矿及稀土矿物。
三、禁止对朝鲜出口航空燃油，包括航空汽油、石脑油类航空燃油、煤油类航空燃油、煤油类火箭燃料，但下列两种情况除外：
1.联合国安理会制裁委员会已逐案特别批准向朝鲜转让已核实用于满足基本人道主义需求的航空燃料，但须做出特别安排以有效监测运送和使用情况。
2.向朝鲜境外的民用客机销售或供应仅供在往返朝鲜飞行期间使用的航空燃油。

本公告自公布之日起执行。
