石家庄山寨狮身人面像被拆 疑遭埃及再次投诉
新京报讯 （记者程媛媛）昨日，河北省石家庄复制版“狮身人面像”建筑被拆分，身首分离。该建筑曾备受争议，并遭到埃及文物部门投诉。对于拆除原因，园区方面暂未回应。
疑似遭埃及文物部门再次投诉
昨日，石家庄长城影视动漫旅游创意园，多名工人正在拆除山寨“狮身人面像”，其头部与躯体已经分离，分别用蓝色挡板和黑色纱布围挡。
当地村民说，该狮身人面像于今年春节前被拆分，疑似遭埃及文物部门向联合国教科文组织再次投诉。对此，建筑所属园区和施工方暂未回应。
据了解，该“狮身人面像”于2014年开始建造，高约20米，身长约60米。该建筑所属园区负责人称，建造用途为影视拍摄，并非旅游景点。
当年5月，埃及文物部门曾向联合国教科文组织投诉。埃及文物部门主席阿里表示，如果建造“狮身人面像”目的是为了拍电影娱乐，按照国际公约，施工方必须通知埃及方面。
阿里认为，山寨版“狮身人面像”细节处理方面与原版差距较大，会影响游客对埃及古文物原貌的了解，也会直接影响到埃及旅游及连带影视产业的收入。

昨日，创意园区相关负责人说，影视城内所有建筑均用于影视剧拍摄，狮身人面像自建造以来一直备受争议，加上曾被投诉，建成后很少用于拍摄，对于其内部构造并不清楚。此外，其建成后吸引了很多游客，据其了解，曾有村民自发收取费用。

此类山寨行为难从法律层面解决
中国未来研究会旅游分会副会长刘思敏博士介绍，文化遗产的保护主要有两个国际公约：1972年《联合国教科文组织对世界文化和自然遗产保护公 约》和2003年《保护非物质文化遗产公约》。1972年的《公约》侧重于物质性的“文化遗产”进行保护，着眼点是保护遗产，使其不被破坏，但没有知识产 权方面的相关规定。根据现有国际法及国际惯例，埃及“狮身人面像”也很难受到知识产权相关法律的保护，其著作权也超越了一般50年的保护时限。而复制、抄 袭具有知识产权保护的现当代建筑很难避免法律制裁。
“像北京世界公园就有许多微缩的建筑，这是没有关系的。”刘思敏说，但按照原比例复制建造会对原始建筑所在国家造成一定影响，不尊重对方文化。刘思敏指 出，仿制名胜古迹的现象在中国以及许多国家都存在：奥兰多迪斯尼世界公园仿制了世界各地许多的著名建筑，包括中国的天坛。帕特农神庙在希腊首都雅典如今庙 顶已坍塌，但美国田纳西州的纳什维尔全盘复制了帕特农神庙，建筑物的规格都同历史上的帕特农神庙一样。

刘思敏指出，如今旅游业界频繁出现复制、仿造现象，具有一定的新鲜感，吸引眼球。虽然这种缺乏创造力的抄袭行为不值得提倡，但不意味着它们不受市场认同。另一方面，抄袭、复制名胜古迹或世界遗产的行为法律代价低。
刘思敏表示，山寨“狮身人面像”一事，虽然埃及方面目前很难从法律上控告和起诉，但作为一个标志事件，引发了联合国教科文组织关于世界遗产产权保护公约的讨论与修改，明确世界遗产的知识产权属性与权利人，对仿制、复制行为加以法律规范。
