预交各种费用，还有给领导送礼的钱
日前，房山法院审理了一起情侣在招聘网站发布虚假招聘信息，骗取应聘者体检费的案件，记者搜索发现，预交培训费、工装费、饭卡费等也是常见的理由，甚至还有给领导送礼的费用。
29岁的于浩来京打工数年，一直租住在大兴区。2014年8月，于浩从新闻中得知网络虚假招聘的赚钱“门路”。于是他辞掉工作，开始在招聘网站上发布“高薪急招长途跟单员，月薪6000元至8000元”的信息。
被害人李林是山东人，看到招聘信息后，便联系于浩，于浩让他到大兴黄村镇。2014年11月，李林按照对方要求到了大兴区，于浩开了一辆银白色越野车将李林接走，来到一家物流园。
“于浩让我交600元的培训伙食费、100元饭卡钱，还有给领导送礼的1400元，之后他用他的杂牌手机把我的苹果5S手机换走，说用一两天就给我。”李林说，当他按照对方要求到了指定地点，发现不像公司和培训的地方，李林感觉被骗，于是报警。
大兴法院审理发现，于浩先后骗取22名应聘者钱财2万多元。于浩因此被判处有期徒刑一年两个月。
在这类网络招聘诈骗案件中，犯罪分子往往抓住务工人员急需找工作解决生计的心理，被害人大多学历较低，法律意识淡薄，因急于找工作而疏于防范。
只招女大学生，卡里余额不多的通不过面试
初入社会的大学生也是网络招聘诈骗的目标群体。去年7月份，杭州警方破获了一起利用网络虚假招聘，专骗应届女大学生的案件。
王敏是一名面临毕业的大学生，2015年6月底，她在招聘网站上看到一家名为“杭州华伦集团”招聘应届女大学生的信息，于是投递简历。几天后，王敏收到面试通知。部门经理以公司需要办理工资卡，以及查询个人信用为由，询问小王银行卡里的余额是几位数。
之后，王敏被要求交3000元培训费。当王敏前往培训教室时，培训老师反复告诫王敏，“你这个岗位很辛苦，你真晦气，怎么应聘这个岗位，但是也来不及了，违约要付6000元的违约金呢。”最终，王敏放弃了暂扣的3000元，慌忙离去。事后，王敏才惊觉自己被骗，赶紧报警。警方共抓获嫌疑人员11名，13名应届女大学生被骗。
审查中，嫌疑人交代，刚毕业的女大学生，社会阅历浅，好骗，好控制。那些卡里余额不多的，不会通过面试。
招聘是假谋财是真，女子大声哭泣被掐死

和郭霞的不幸遭遇相比，刚刚来北京的女孩孟琳的经历更为悲惨。去年2月份，22岁的女孩孟琳从河北老家来到北京找工作，她在招聘网站看到一条招聘超市收银员的广告。孟琳通过上面的手机号，联系到了程某。第二天，程某约孟琳在某小区的一层楼道口见面。程某对孟琳说今天是情人节，能否与其发生关系，遭到拒绝后，程某强行将孟琳拽到地下室三层抢劫。其间孟琳一度惊慌失措，大声哭泣。
“地下室回音很大，我不让她大声呼叫，她不听。”程某说，他在将孟琳装有钱包和手机的背包抢走后，猛掐孟琳颈部，并将其抛掷到地下室的污水井内，最终导致孟琳机械性窒息死亡。
据程某交代，他之所以狠心杀死孟琳，是因为他感觉所抢的东西不值钱，再加上对方大声哭泣，他担心事情败露，为了掩盖犯罪事实而为之。去年12月，市三中院判决程某犯故意杀人和抢劫罪，一审判处其死刑。
通过网站应聘被骗，男子告赶集网被驳
虚假招聘信息的发布者涉嫌诈骗罪等罪名，理应受到法律制裁，那么为这些信息提供传播平台的招聘网站是否负有法律责任呢？
刘猛今年31岁，据其称，2014年4月，他在赶集网上看到一个名为“新希望集团”的招聘广告，于是和该单位联系，并按照对方要求前往天津武清参加公司实习。“然而，当我到达武清与招聘方人员接洽后，发觉招聘方人员行为举止怪异，似欲对我进行欺诈、监视和控制。”刘猛说，他借机报警，随后离开天津。之后，刘猛才发现，该招聘单位根本没有组织此次招聘。
“赶集网应对经由其网站发布的招聘信息进行最基本的审查核实。”刘猛称，他曾以用工单位的身份，在赶集网上发布一条虚假招聘信息（试验过后已立即删除）。“我只是随意虚构了一公司名称就能顺利发布招聘信息。这说明赶集网根本没有任何审核。”
刘猛将赶集网所属的山景科创公司告至海淀法院，索赔7000多元，包括事发日实际损失、精神损失及事后维权成本等。
被告山景科创公司辩称，赶集网平台发布的信息都是网络用户发布，赶集网不是直接侵权人。服务条款中已经告知用户相关风险、自我防范意识以及维权措施。
法院审理认为，本案中无证据显示被告利用网络技术对相关信息实施了主动编辑、修改等网络传播行为，并获得直接经济利益。法院最终驳回了刘猛的诉讼请求。
律师解读
招聘网站只承担，有限的审核义务
北京市威宇律师事务所律师程晓文认为，招聘网站是一个开放性的网络服务平台，其信息具有海量性特点，且属于网络用户无偿发布、无偿获取的网络信息，“网站审核义务的范围和大小应与其提供服务的方式相匹配。”
程晓文说，这类网站的个人用户是非实名注册，企业用户则需提供营业执照等企业信息资质，招聘网站只核实该企业是否存在真实，但这只是一个形式审查，至于该企业发布的信息是否完全真实，招聘网站没有义务、也没有能力去审核。
“如果是免费的招聘网站，而且网站没有宣传保证其推介的招聘信息都是属实的广告，则通常是免责的。如果招聘网站并不知道企业有诈骗的主观性，而参与招聘信息的推荐、编辑等，则要承担一定的民事责任；如果网站明知该企业有诈骗之嫌疑，还帮忙推荐、编辑招聘信息，则要追究网站负责人的刑事责任。面对海量的免费招聘信息，网络用户自身应持谨慎态度并承担一定的注意义务，以更好维护自身权益。”程晓文律师说。
