　　2013年5月28日，被告人敖红、黄爱民在复旦大学纪律检查委员会找其询问相关情况时，即如实供述上述基本犯罪事实。审理中，被告人敖红退赃30万元。

　　原审法院认为，被告人敖红、黄爱民身为国有事业单位中从事公务的人员，利用职务便利，将应由动物实验室承接的相关实验服务项目所得收益，以虚假发票报销的方式予以侵吞，共计147万余元，其行为构成贪污罪，且系共同犯罪。

　　本案中，敖红主要负责承接项目，黄爱民主要负责结算、报销，两人各有分工，互相配合，作用相当，不宜区分主从。公诉机关指控罪名成立。被告人敖红、黄爱民具有自首情节，依法可以从轻处罚。被告人敖红有退赃行为，具有一定的悔罪表现，酌情从轻处罚。被告人黄爱民无退赃行为。

　　据此，法院依法判决被告人敖红犯贪污罪，判处有期徒刑十年，并处没收财产八万元；判决被告人黄爱民犯贪污罪，判处有期徒刑十二年，并处没收财产八万元；被告人敖红、黄爱民的违法所得予以追缴。

　　判决之后，两名被告均认为“量刑太重”，提起上诉。

　　激辩：关键证据“秘不示人”？

　　本案激辩的焦点之一，便是敖红和黄爱民能否承接项目？

　　检方援引证人黄德桥（动物部原党支部书记）的证言，证明两人不能承接，“首先是两人均未达到高级职称，根据动物部的规定不能承接服务项目，也没有经费本；其次，两人的本职工作是为动物部承接服务项目，否则会造成公私不分。”

　　对此，两名被告人均表示很冤枉，“其他同事也在做同样的事情，只要跟别人签合同，就可以去科研处领经费。”敖红认为，自己多年来都只是个讲师，就是因为不能参与科研项目，拿不到数据，出不了高质量的论文，因此“打擂台”时每次都落败。她曾要求不做这个主任，但被领导拒绝。

　　敖、黄的辩护人都认为，“这个所谓规定只存在于动物部的会议记录，但至今我们也未见真容。这条所谓规定，不仅违背了复旦大学主管科研的科技处的相关规定，也未经庭审质证。如果以这样一份道听途说的证据作为量刑依据，显然不当。”

　　激辩焦点之二是，一审法院认定的贪污金额是否合理？量刑是否过重？

　　实验动物需要特定的温度、湿度、气温、噪音、饲料、饮水等条件，工作人员的职责就是维持这一标准，为实验的动物提供打针、灌胃、造模、转基因保种等服务，记录死亡的数字。敖红介绍，动物实验室一般只是代养、管理大鼠、小鼠，明码标价一天多少钱。

　　按照敖红、黄爱民的陈述，他们“接私活”不是接这样差不多的，而是例如保种、模型等，这种服务产生的利润较高，能套取更大的利润。有些是上课的研究生找到他们，觉得效果不错，后来又多次合作。

　　辩护律师认为，不能把两人的劳动报酬、合理支出等也算入贪污金额，147万元的金额太高。原审法院认为，不论是以动物部名义承接的业务，还是以被告人名义承接的业务，凡是利用动物部的公共服务平台的资源包括人力资源完成的，其收益理应归属于动物部。

　　黄爱民说，承接实验室服务项目的成本主要是购买动物、试剂、车费、餐费等，套取利润就是将别人支付的校内凭证附发票直接去财务处报销，扣除一些成本就是利润，二人基本均分，其个人拿到约55万元。假发票从上海火车站购买的。

　　自己实际承担了两份工作，主要是教师，兼任动物实验室主管，但自己每月四五千元的收入，仅仅是作为教师的报酬，动物实验室主管是没有收入的。每个月四千多元工资，还有一千元左右的奖金，扣去房租，所剩无几，还要担负女儿的辅导班等费用，蛮吃力的。
