　　针对上海市公安机关侦破的假冒“雅培”、“贝因美”商标婴幼儿乳粉案件，国家食品药品监督管理总局新闻发言人表示，该案是违法犯罪分子通过收购廉价乳粉、包装变形的乳粉加工罐装冒牌乳粉的案件。

　　新闻发言人强调，总局4月4日通报涉案产品经办案机关检验符合食品安全标准，但属于冒牌食品，主要是提醒消费者如果购买食用了该冒牌产品，不要过于恐慌。但生产销售冒牌婴幼儿乳粉，属商业欺诈、侵犯知识产权的违法犯罪行为，一经发现，不论其质量是否合格，是否对公众健康构成威胁，必须对涉案乳粉立即扣缴，一律销毁。我们支持消费者向冒牌产品的生产经营者依法索赔。

　　国务院食品安全办已督促该冒牌产品流向地河南、安徽、江苏、湖北省进一步追查涉案产品，依法严惩生产销售冒牌婴幼儿乳粉的违法犯罪行为，切实保护消费者的合法权益。
