斯米兰国家公园巡逻人员证实涉事船只属于Panunee 公司，为曼谷一家专门从事旅游游艇的公司。昨日晚间，新京报记者致电该游艇公司负责人，对方表示捕鱼船只确实为公司所有，但游艇不提供捕鱼工具，并不了解 游客在船上的捕捞行为，公司船只和工作人员亦从未从事非法捕鱼活动。该负责人称，由于自己在日本出差，未及时了解到捕鱼情况，其随后向香港旅游代理公司反 映情况，香港公司表示并不知情。
船长称在保护区外捕鱼
新京报记者了解到，攀牙府警方已于4月4日拘捕了涉事船只的船长和一名船员，船长拉尔曼证实捕鱼属实。拉尔曼介绍，3月29日至4月2日期间，带领20名中国游客游玩，但由于在夜间接到游客，并不清楚游客自行携带了哪些捕鱼工具。
攀牙府警方要求船员提供船只停靠后进行捕鱼的准确方位。一名船员对警方称，他们停靠的位置在斯米兰群岛4海里以外的海域。船长拉尔曼表示这是船只的正常 路径，不在国家公园的范围内。但泰国警方表示，船员提供的定位与AIS（船舶自动识别系统）定位报告不相符。拉尔曼解释称停靠船时，没有启动AIS系统， 所以无法显示事发位置。
对此，斯米兰国家公园负责人纳特对媒体称，船长无法证实捕鱼的位置不在公园内，而游客使用的捕鱼工具也不能成为证据，该船只有运载游客的许可证，但并非合法的捕鱼船只。
纳特表示，斯米兰是泰国著名的海洋国家公园，是闻名世界的潜水天堂。泰国海军负责在各潜点及下锚区装设浮标以供船只悬系之用，不准任意下锚，以免伤害珊瑚等生物。
公园内的海洋生物十分稀有珍贵，应该受到特别的保护。事发后，海洋公园方面表示，会安排工作人员对船员和导游进行培训，以确保他们知晓公园的领域。

经调查，泰国警方确认涉事船只是当地出租的私人船只。据船员介绍，这批游客抵达国家公园后，租赁游船进行潜水活动，但随后提出钓鱼要求。船长拉尔曼表 示，国家公园海域禁止钓鱼，但游客仍要求到国家公园以外的海域钓鱼。因无法与船主（即Panunee公司）取得联络，船员以为在国家公园以外的海域钓鱼合 法，遂将船只停泊在国家公园海域外4海里，游客开始在海中钓鱼及捕捉龙虾等其他海洋生物。
当地国家海洋公园高级顾问索恩博士在接受媒体 采访时表示，斯米兰附近拥有丰富的海洋生物资源，也因此容易遭到捕捞，但近年来大量捕捞事件很少发生。索恩表示，如果游客在公园保护领域外捕鱼将很难受到 惩罚，也不会面临拘捕，“一旦离开了捕捞现场，将很难对他们进行惩罚。”索恩提醒称，在泰国海洋公园和其他受法律保护的海域内捕捞海洋生物是非法行为，应 当引起游客注意，一旦被公园巡逻人员发现，将会面临相应的惩罚或者被警方拘捕。

刘思敏称，如果游客不知道该地区禁止捕鱼，属于误操作的话，这些游客不应被列入旅游黑名单中。如果明知故犯，存在主观故意，那么根据《国家旅游局关于游 客不文明行为记录管理暂行办法》（下称《办法》）相关规定，经“游客不文明行为记录评审委员会”认定后，可被列入游客不文明行为记录。
上述《办法》被旅游业内称为“游客黑名单”，新京报记者了解到，游客不良信息保存期限为一至两年，期限自信息核实之日起计算。如果游客的不文明行为造成严 重不良后果，必要时会向公安、海关、边检、交通、人民银行征信机构通报，这将会影响到游客再次旅游，严重的甚至会影响到出境、银行信贷等。
