云南检察机关对一起污染环境案提起民事公益诉讼
中新网4月8日电  据最高人民检察院网站消息，2016年4月8日，云南省普洱市人民检察院就云南景谷矿冶股份有限公司(以下简称景谷矿冶公司)污染环境违法行为，向普洱市中级人民法院提起民事公益诉讼。
　　景谷县人民检察院在履行控告检察职责中发现，位于景谷县的景谷矿冶公司选冶厂8号料液输送管道断裂，致使硫酸铜料液通过排洪道泄露，导致景谷县民乐镇白象村和民乐村部分农田和菜地被污染，民乐镇部分河段鱼类浮头和死亡，造成当地村民直接损失51.223万元。污染事故发生后，景谷矿冶公司对受害村民直接损失进行补偿。经云南德胜司法鉴定中心鉴定：除直接损失外，此次环境污染损害数额量化结果为135.83万元，其中包括：农田环境污染损害费用52.86万元，生态环境损害修复费用82.97万元。景谷矿冶公司至今并没有对此进行赔偿，社会公共利益仍处于受侵害状态。景谷县人民检察院根据有关管辖规定，将该线索移送普洱市人民检察院。
　　为保护生态环境，维护社会公共利益，普洱市人民检察院在履行诉前程序后，根据《中华人民共和国民事诉讼法》第五十五条、《全国人民代表大会常务委员会关于授权最高人民检察院在部分地区开展公益诉讼试点工作的决定》、《检察机关提起公益诉讼试点方案》、《人民检察院提起公益诉讼试点工作实施办法》的相关规定，就该案向普洱市中级人民法院提起民事公益诉讼。
