记者今天从浙江省宁波市鄞州区人民法院获悉,近日,鄞州区法院审理了一起微商贩卖美容假药案。一名做微商的湖北籍女子,在无相关资质的情况下,将美容假药肉毒毒素通过朋友圈进行销售,并提供注射服务,获利两万余元。法院经审理后判定,被告人明知是假药而予以销售,其行为已构成销售假药罪。被告人到案后能如实供述自己的罪行,依法可以从轻处罚,判处有期徒刑一年,并处罚金人民币三万元。
据了解,女子晓玲(化名)几年前跟着老乡来到宁波工作,之后也赶着微商的大潮在朋友圈做起了卖面膜、化妆品的生意。2015年上半年,晓玲在一家美容店做美容,该店老板张斌(化名)加了她微信,之后两人在微信上越聊越投机,张斌就跟晓玲说起现在注射玻尿酸、肉毒素挺火的,学起来方便赚钱也容易,美容药品可以从他那里进货,而且他还经常举办相关的注射课程培训,晓玲听后很心动。
之后,张斌就将晓玲拉进一个有两三百人的微信群里,这个群里都是从事微整形行业的,也有和晓玲一样刚刚接触这一行业的新人,晓玲认真地向群里的人取经。
一段时间后,张斌告诉晓玲,他马上就会举办一期关于微整形注射的培训班,问晓玲要不要参加。晓玲同意了,交了几千块的培训费,参加了这个所谓微整形注射的课程。
培训时间4天,第一天学习理论,后面都是实践课程。培训回来后,晓玲就开始从张斌那里以每支400元至500元的价格购买了一批美容药品,有A型肉毒毒素及玻尿酸等产品,这些产品均未标示注册号,也无中文标识。
此后,晓玲开始在微信朋友圈里发广告出售肉毒毒素、玻尿酸等美容产品,并提供上门注射服务,收费为每次1000元至1500元。广告发出后,陆续有人来找晓玲打美容针,晓玲都上门提供服务,根据培训课上学到的技术给顾客进行注射。后来晓玲在张斌没货时,也从微信群里其他人处购买过少量美容注射药品。
2015年12月,民警在晓玲的住处将其抓获,当场查获疑似假药近100盒。经鉴定,被查获的药品中肉毒毒素A等4种产品未标示进口药品注册证号,应按假药论处；玻尿酸等7种产品为未经注册的第三类医疗器械。
根据在晓玲处注射过美容药品的顾客反映,晓玲在给她们注射前并未进行任何过敏性反应等测试,而是直接擦了碘酒就注射。注射后并没有出现明显的美容效果,但也未产生严重副作用。其中有一位顾客反映,其脸部注射过的地方曾出现过硬硬的未溶解的感觉,后来又让晓玲将药物取出,发现是药物没有溶解造成的。
晓玲到案后不久,张斌也被警方抓获。
2016年3月,公诉机关以晓玲犯销售假药罪向宁波市鄞州区法院提起公诉。
鄞州区法院依法进行公开开庭审理。庭审中,晓玲当庭认罪,并对自己的违法行为感到后悔万分,表示将不会再犯。
