  在首批民航旅客不文明行为记录中,登上“黑名单”的3名旅客,记录期限分别为1年和2年。根据《民航旅客不文明行为记录管理办法》,对已经造成严重社会不良影响,但没有受到行政处罚的,旅客不文明行为记录期限为一年;受到行政处罚的,旅客不文明行为记录期限为二年。因为扰乱航空运输秩序而被国家旅游局等其他政府部门列入相应记录的,记录期限依照相关部门规定执行。

  中国航空运输协会每个月会从民航局获取不文明行为旅客信息,更新记录后会告知航空公司、中国民航信息集团公司和旅客本人。不过,“黑名单”上的旅客是否在记录期内不能乘坐飞机呢?目前,中国航空运输协会还并没有具体的处罚细节。

  不过今年2月1日,也就是在《民航旅客不文明行为记录管理办法》开始生效的同时,国内五家航空公司,包括中国国航、东方航空、南方航空、海航集团和春秋航空,共同签署了《关于共同营造文明乘机大环境的联合声明》。春秋航空新闻发言人张武安表示,大家将合力对不文明旅客采取限制措施。

  张武安说,去年国家旅游局出台了不文明旅客的《管理办法》;上个月,中国航协也出台了不文明旅客行为记录的管理办法。五家航空公司此次签署的联合声明,是这些管理办法的落地措施。可能会是在订票上有一定的限制。

  旅客进入黑名单之后,满足哪些条件才可以退出呢?春秋航空新闻发言人张武安介绍了春秋航空的做法:“我们春秋航空在2007年开始,就已经实行了一个‘暂无能力服务的旅客名单’的办法,我们当时对霸机、抢占霸占候机楼或登机口等行为,采取一定的限制措施。假如客人认识到自己的行为,能够修正自己的行为,我们就可以解除限制。”

  中国民航大学航空运输经济研究所所长李晓津认为,不管从监管部门的角度,还是从航空公司的角度,新政落实还需要持续的推动。

  李晓津说:“这个规定应该会逐步落实,主要原因有两条。第一,就是法理依据。我们国家的合同法第289条规定,从事公共运输的承运人不得拒绝旅客托运人通常合理的要求,也就是说航空公司可以拒绝旅客和托运人不合理的要求;从民航局以及中航协从保护广大旅客利益、维护飞行安全的角度出台的这个办法,也已经形成了相关文件,因此从法理上来讲没有问题。第二,最近中航协也开始适用分别受到了一年、两年的限制飞行的处罚。因此在实践看到也可以逐步落实的。”
