  一块办公用地经过几轮“变脸”,最终被用作建设联排私人住宅,其中分配给领导的住宅,有的规划建设面积达五六百平方米。近日,国家重点扶持的贫困县广西都安瑶族自治县人民法院违规建房问题被查处,包括副县长、法院院长等在内的13名干部被纪律处分。


  土地出让与城市规划有严格的程序、法律法规,那么,这起违规建设是如何实现的?


  被查处的都安县法院干警住宅项目,位于都安县城北部屏山北路,紧邻法院办公楼。记者近日在现场看到,这些住宅大部分已经打好了地基,有的已建至三层。


  都安县法院办公室副主任韦锦欢告诉记者,项目于去年1月被叫停。该住宅小区计划建设130套住房,包括70套联排住宅和60套普通住宅。


  当地住建部门出具的《建设用地规划许可证》显示,这片联排住宅规划建设5层,每套占地80平方米至110多平方米不等,建筑面积均在400平方米以上。其中,8号楼的5套住房折算下来,单套住宅规划建筑面积为550多平方米。


  虽然该住宅以“法院干警小区”名义建设,但130名业主中却有38人并非法院职工,有的是私企老板。法院提供的信息显示,8号楼的业主为覃洪斌、唐秀辉、韦挺、蓝锋、韩俊步等5人,均为时任都安县法院领导。其中,覃洪斌为法院院长。


  据了解,都安县法院小区所占土地原是在2006年被以“都安县人民法院迁建项目”征收。根据河池市政府的批复,同意把国有土地合23.5亩划拨给都安县法院作为办公用地,把国有用地3.3亩出让给法院作为住宿区。但事实上,都安县法院最终只用了这块地的一小部分建设办公楼,其余大部分用于建设干警住宅。


  位于大石山区的都安县,自然环境是典型的“九分石头一分土”,土地资源十分稀缺。在这样的地方建公务员超大“豪宅”,引发当地群众不满。


  办公用地为何能修建单套面积超大的联排豪宅?记者调查发现,这块地经过三轮“变脸”。


  --设定条件“萝卜招标”,排除竞争者顺利拿地。2009年,都安县法院以“迁建项目办公用地面积相对过大,而住宅用地明显偏小,造成部分土地没有科学合理利用”等理由,向县政府要求改变规划。县政府常务会议同意法院“通过市场化运作的方式依法依规改变土地用途”。报经河池市政府同意后,这块地按程序挂牌出让。


  为让土地顺利出让给法院建设“法院小区”,国土局在“出让方案”上明确:“竞买人必须承诺同意提供118套毛坯房总计建筑面积16900平方米给都安县人民法院作为干警住房,房价为每平方米900元”。2010年,在设定条件“萝卜招标”之后,法院组织115个自然人联合竞买,以总价862万元的底价购得。


  --分块办证建设,“擦边球”式审批突破禁建独立式城镇居民私人住宅相关规定。都安县住建局副局长、时任建设局规划股股长钟惠琳说,拿到地之后法院提出建设“楼中楼”,一套房从1层到4层,申请分块发证,在时任建设局局长黄显生批示分块办理后办理,并在审批图纸上标注每户业主住宅的位置。


  每两套“楼中楼”中间共用一堵墙。规划部门当时称,这可以不算“独立式”住宅。这种“擦边球”式的审批,令法院在事实上可以修建私人住宅。


  --超容积率办建设许可,普通住宅变超大“豪宅”。按照规划和土地出让协议,该小区容积率应小于2.45,但这难以满足建设超大住宅的要求。于是,法院又向县政府申请“将该宗建设用地容积率变更为4.5”。在签批件上,国土、住建部门及分管副县长均同意调整。


  这块地最终未完成提高容积率的手续,但都安县住建局在2011年给法院职工发放《建设用地规划许可证》,许可的建设面积超过容积率,达到3.83。


  河池市纪委近日通报称,都安县法院住宅小区项目建设过程中,相关部门存在设置不合理限制条件、违反规定出让国有土地;违反国有资产处置程序转让国有土地资产;违规将地块拆分发放规划许可证并规划建设私人住宅楼;违反规定提高土地容积率建设;相关职能部门执法监督不力等严重违规违法问题。依据相关规定,河池市纪委对时任分管副县长以及法院、国土、建设等部门共13名责任人进行纪律处分。


  在都安县国土、住建部门,记者看到关于建设法院小区建设的文件10多件,一些文件有县领导、职能部门负责人、经办人员的层层签批。完善的程序为何挡不住违法建设?


  “在法院干警小区申请建设过程中,一开始我是拒不受理审批的,最终因为领导的施压,被迫办理。”钟惠琳说,超过容积率且分块办理《建设用地规划许可证》是她任规划股股长期间办理的,因此受到行政警告处分。


  据河池市纪委通报,时任都安县住建局局长黄显生受到党内严重警告、行政记大过处分。钟惠琳说,在违规分块办证时,她是在黄显生批示分块办理后办理的。


  在都安县法院递交的“将我院新址的住宅用地变更为干警住宅用地的请示”文件处理笺上,国土部门提出处理意见后,时任副县长潘广军签署“同意”。潘广军受到行政警告处分。


  受到党内严重警告、行政记大过处分的都安县法院副院长韦德厚说,建房的方案当时都是经过院领导班子讨论决定的。在这起事件中,都安县法院多名干部受到不同程度处分。其中,时任法院院长覃洪斌受到开除党籍、开除公职处分,将其涉嫌犯罪问题移送司法机关依法处理;继任院长韦江雁受到撤销党内职务、行政撤职处分,行政级别从副处降为正科,调离法院队伍。


  都安县法院纪检组长覃巧红说,现在这片建房的土地使用权被政府收回,并注销了相关的国有土地使用证。


  “明知是违规违法行为,却因层层签批要求办理,或以‘打擦边球’方式实现貌似程序合法,是在玩弄法规。”西南政法大学教授陈步雷认为,信息公开是避免暗箱操作、违法审批的利器。应将每个项目的审批文件上网接受公众监督。同时,在公务员法中应明确有“及时抵制、制止、举报违法犯罪行为”的法定职责义务,由上级监察部门和检察机关受理相关举报。
