15日,记者来到拉卡拉上海分公司,相关人员称,拉卡拉信用卡还款业务不在上海区域业务范围内,无法受理,需要联系北京总部。

记者致电拉卡拉服务热线,客服人员表示,通过拉卡拉给信用卡还款,一般2个工作日之内到账。对于王先生反映的问题,公司技术人员检查后,没有发现后台异常,有可能是王先生在扫描信用卡时,光线模糊造成识别错误,用户没有核查出来。此外,拉卡拉的转账业务必须账号和姓名一致,但信用卡还款只需要账号无误就可以,姓名填写一栏仅为方便管理。

光大银行客服人员也证实,在第三方还款支付渠道中,目前信用卡登记姓名与还款申请姓名即便不一致,也可以还款成功。

图像识别存在一定错误率

王先生认为,如果是光线模糊导致识别困难,拉卡拉手机客户端应该提示无法识别或是建议手动输入,而不是导入一个错误的卡号。

据一家支付机构业内人士介绍,拉卡拉手机客户端的拍照扫描功能采用的是图像识别技术,对图像进行处理、分析和理解,进入数据库识别比对。物体所处的光线环境、运动状态等会影响识别,若信用卡卡号磨损划痕,也会导致误差,存在一定的错误率。

那么,这一问题应该由谁来监管呢?

上海银监局工作人员称,拉卡拉作为第三方支付机构属央行管理。而根据央行颁发实施的《非银行支付机构网络支付业务管理办法》相关规定,第三方支付机构应当具备必要的技术手段,确保支付指令的完整性、一致性和不可抵赖性以及支付业务处理的准确性和安全性。

[律师说法]拒不归还错汇钱款构成不当得利

上海佳誉律师事务所李维律师表示,当事人王先生汇款失误,有详细的交易资料,并且没有证据显示双方相识,对方在没有法律依据的情况下收到当事人汇款,造成当事人损失,如拒不归还,就构成不当得利。若当事人联系不到对方,可向公安机关报案。公安机关会要求银行查实对方身份,然后和对方沟通,看其是否愿意把钱退回。若对方不肯将钱退回,当事人可以凭借转账汇款证据到法院提请民事诉讼,法院可采用不当得利的法律条款将钱追回。

此外,当事人还可以携带相关证据到当地法院请求诉前保全。法院会根据当事人提供的账号和用户名,到收款方账户的开户银行查封账号,并根据对方在银行留下的个人信息和对方取得联系。如果对方不承认或不愿归还,根据现行法律规定,法院可以强制执行。
