对此，北京青年报记者咨询了京衡律师事务所律师余超。他表示，作为第三方平台，瓜子二手车直卖网或其他的二手车网站，应承担销售中的连带责任。例如，针对陈先生购买的“凶车”问题，瓜子二手车直卖网对“重大事故”的解释超过了一般人的理解范畴，甚至与国家的法律相违背，侵犯了消费者的“知悉真情权”。如果之前瓜子二手车平台已经知道了车辆的情况，而没有告知购买者，根据《消费者权益保护法》第44条第二款，网络交易平台提供者明知或者应知销售者或者服务者利用其平台侵害消费者合法权益，未采取必要措施的，依法与该销售者或者服务者承担连带责任。

余超指出，如果卖方故意欺诈，买方可向卖方主张退车并要求赔偿损失，如平台明知卖方欺诈而未釆取必要措施，则平台与卖方承担连带责任。
