  据南海区人力资源和社会保障局的通报,今年3月5日,不满15岁的王攀由其母亲匡艮莲介绍进入至雅公司工作,入职时填写了入职申请表并签订了劳动合同,工作岗位为车位工。4月11日上午6点左右,王攀被发现在其居住的出租屋内昏迷不醒,经医生到场后诊断认定处于死亡状态。

  佛山市南海区人力资源和社会保障局副局长吴文华说,业界对如何适用前述规定存在争议,争议焦点是,是否必须要求童工死亡是用人单位“使用”所致才适用前述赔偿标准,不同的地方有不同的做法。“我们把这个条文的情况向当事双方进行了说明,具体如何适用只能通过劳动仲裁和司法判决去最终确定,当事人双方也可以就赔偿问题进行自主协商。”


  广州市一名长期从事劳动案件审理工作的法官说,在司法实践中,本案只有证明王攀的死因与在至雅公司的工作之间有因果关系,才能参照《工伤保险条例》的赔偿标准执行。要查明是否存在因果关系,就必须先通过尸体解剖查明王攀的死因。

  对此,籍新科说,根据国务院发布的《禁止使用童工规定》第六条:用人单位使用童工的,由劳动保障行政部门责令改正并按照每使用一名童工每月处5000元罚款的标准给予处罚。“我局于4月22日依法做出《行政处罚决定书》,对至雅公司3月5日至4月10日期间使用1名童工的违法行为进行处罚,罚款1万元。”


  除了罚款之外,企业是否还应当受到其他处罚?《禁止使用童工规定》第十条规定,童工伤残或者死亡的,用人单位由工商行政管理部门吊销营业执照或者由民政部门撤销民办非企业单位登记。


  佛山市南海区市场监督管理局企业监督管理科科长蒙长深说,根据相关规定,必须由劳动保障部门提请,工商管理部门才能对非法使用童工的用人单位给予吊销营业执照的行政处罚。但目前,未接到劳动保障部门就至雅公司使用童工的问题提请或移送材料。


  吴文华说,业界对前述条文的适用也存在争议,争议的焦点在于,是否要求证明童工的患病或者受伤与企业的“使用”之间存在因果关系才予以吊销营业执照。“我们已经就该问题向上级部门提出口头请示,准备马上进行书面请示。”


  对于此事是否涉及雇佣童工从事危重劳动罪,吴健华说,公安机关正在对至雅公司是否雇佣童工从事超强度体力劳动进行调查,目前正处在调查取证过程中,暂未做出结论。
