互联网在我国普及之后,文学创作获得新的广阔天地,但也笼罩在互联网侵权的“阴霾”之中,遭受着疯狂盗版的“切肤之痛”。网络文学市场面临着怎样的生存状态,未来该如何走出侵权“阴霾”?

网络文学2014年被“盗走”百亿元

34岁的网络作家张威有一个更让人熟悉的名字“唐家三少”。曾经一度工作失意的他凭借网络小说写作,不仅创造了自己人生的辉煌,也创造了一个互联网时代的写作奇迹。在“互联网+”的推动下,“IP”(知识产权)时代创意作品的价值前所未有地被激发出来。

2016年第十届中国作家富豪榜公布了“网络作家榜”名单,他的版税收入达到1.1亿元,已经是第四次蝉联网络作家富豪榜冠军。

然而,像张威一样幸运的网络作家并不多,这一新兴产业上空挥之不去的盗版“阴霾”,不断侵蚀着网络写手们的生活空间和创作热情。在搜索引擎上搜索书名,网站就会自动推荐该作品的贴吧,同时也会显示最新章节及“全部章节”,不用付费就可以很顺利地点击阅读。

另一位网络作家告诉记者,能够卖出版权的网络作家是“凤毛麟角”,多数人只能靠网络读者的订阅付费,但都因为疯狂的盗版行为遭受巨大损失,辛劳付出得不到最基本的尊重和回报,能够靠写作养活自己的人连5%都不到。

记者看到,网络小说成为许多论坛、贴吧争相转载的内容,最新内容几乎都可以在首页找到,通过“置顶”、加“精”、红色标题等方式被突出标注出来,以吸引读者阅读。初步统计可以发现,搜索引擎中小说人气总排行榜前50名的文学作品,处于网络更新状态的小说一共有31本,很多原本收费的小说,在贴吧里面一直在免费更新。

日前,互联网研究机构艾瑞咨询发布的《中国网络文学版权保护白皮书》显示,网络文学经历了萌芽和爆发期,但网络盗版行为却道高一尺魔高一丈,开始向新的模式转变,通过智能手机移动终端传播盗版作品的越来越多,危害也在增大。如果按照正版计价,仅2014年盗版行为就造成整个行业损失将近100亿元。

维权成本超出很多作者承受能力

有关专家认为,网络技术普及为文学创作传播创造了一个低门槛、便利化的环境,使文学作品能够更加便捷地传播阅读,获得广泛的受众群体。但同时,在互联网环境下盗版侵权行为的隐蔽性、危害性都进一步增强,也给知识产权保护带来更大的挑战。

韬奋基金会理事长聂震宁认为,经济利益是驱动网络文学盗版行为的核心因素。网络文学盗版使大量需要付费阅读的作品可以免费或者以较低成本阅读,是对作者及平台运营方劳动成果和知识产权的窃取,严重影响了其收入。许多盗版者、盗版平台通过吸引用户阅读盗版网络文学作品,以达到吸引并聚合用户流量,实现增加广告收入牟利的目的。

据了解,目前网络文学盗版已经形成了一条完整的灰色产业链。首先,专业化的盗版者通过盗版软件等技术手段,或干脆使用“手打”方式获取正版内容,然后再通过搜索引擎、浏览器主页连接进行推广,吸引用户阅读,从而获取网络流量。同时,在浏览内容中嵌入广告,通过广告联盟赚取巨额广告收入。最后,搜索引擎运营商、广告联盟与盗版者站按照一定比例分享收益。

业内人士透露,依靠专业的团队运营,对网络文学作品几乎可以实现“秒盗”。一般首发网站发布新章节1分钟内就可以完成盗版。即便首发网站需要读者登录付费,通过专门的网络盗版软件,盗版者已经可以直接从正版网站主动且实时抓取最新章节内容。

聂震宁表示,随着网络技术的发展,盗版侵权模式变得更加复杂及隐蔽。由于互联网的虚拟性,对这种盗版模式的打击收效甚微。当前,许多文档分享平台注册不需要实名认证,云储存和应用软件等新型侵权手段使版权方难以有效控制内容传播,维权投入不断加大,已经超出很多作者个人和运营平台的承受能力。

盗版惩罚不能“高举轻落”

“目前,高昂的维权成本与低廉的侵权成本形成鲜明的对比,盗版产业链的存在给盗版者提供了源源不断的资金支持。”聂震宁表示,网络文学版权不仅仅只是文字和阅读,还进一步涉及影视、游戏等产业的创意创新基础。如果网络文学版权乱象继续蔓延下去,最终将严重伤害数字文化创意产业的发展。

有关专家认为,挥之不去的盗版“阴霾”背后除了法规政策相对滞后,还有各个执法部门的监管技术短板。中国文字著作权协会总干事张洪波表示,侵权成本低、法律赔偿额低等问题,直接助长了侵权盗版行为的蔓延。

深圳罗湖区法院知识产权庭法官唐亦丽说,实际判案中最困扰的就是侵权赔偿额的计算。很多情况下,由于对侵权行为的举证不足,赔偿额往往低于作者预期。

北京市版权局副局长王野霏表示,网络平台涉及几十万上百万的在线作品,执法部门需要投入大量的人力物力,但是仅靠自身的技术能力,难度很大。为了提升监管能力,需要不断探索调动社会专业机构、权利人等的力量,形成社会各界共同治理的模式。

今年全国两会期间,聂震宁等32位全国政协委员提交相关提案,呼吁加强网络版权的法律保护,制定《信息网络传播权保护条例实施细则》等相关法律法规,尽快完成《著作权法》第三次修改,进一步完善著作权法律制度,为数字文化创意产业提供更加完善的保障。

中国人民大学教授宋建武认为,网络时代文学作品的数字化传播使得版权保护难度越来越大,一方面要继续加大法律制度的完善,同时还要探索如何通过技术手段提升保护能力。执法部门要对网络盗版行为形成有效的监管,就必须提高自身的技术能力,同时权利人也应该积极利用新技术来保护自己的作品权益。
