　　新华社南昌4月28日电(记者 赖星)江西省高级人民法院27日依法作出决定，对原审被告人黄志强、方春平、程发根、程立和故意杀人、抢劫、强奸、敲诈勒索一案进行再审。

　　2000年5月，江西景德镇市所辖乐平市发生一起故意杀人、抢劫、强奸、敲诈勒索案(“5·24案”)。2003年7月，景德镇市中级人民法院一审判处黄志强、方春平、程发根、程立和死刑。2014年1月，江西高院以事实不清、证据不足为由发回重审。景德镇中院经重审于2004年11月仍对四名被告人判处死刑。2006年5月，江西高院终审判处上述四名被告人死刑缓期两年执行。宣判后，黄志强、方春平、程发根、程立和不服，提出申诉。

　　江西高院经审查认为，申诉人黄志强、方春平、程发根、程立和提出的申诉理由符合法律规定的重新审判条件。依照《中华人民共和国刑事诉讼法》第二百四十二条第(一)项、第二百四十三条第一款、第二百四十五条第一款的规定，决定本案由江西高院另行组成合议庭进行再审。(完)
