1日生效的这项法律禁止的是对住房的“错误使用”,即擅自将其用途改为度假公寓供短期出租。根据德国房地产投资与开发协会测算,目前,全德境内至少有4.64万间私人住宅被作为度假公寓短期出租。该协会数据显示,2015年,旅客在柏林的私人住宅内过夜天数总和超过610万,使得柏林成为全德国最大的网络短租市场。

推动此项法规出台的柏林州参议院认为,柏林的城市规模一直在扩张,而当地的新建住房已长期不能满足人口增长所带来的需求——故此,柏林州参议院认为,此举将缓解目前当地房地产市场存在争议的发展状况。

不过,与业界老大Airbnb选择“息事宁人”,主动下架柏林房源的做法相比,另一家网租房平台Wimdu和它的60余名房主可不打算就这么“认栽”。他们与Wimdu公司一起提起诉讼,要求法院判决新法规无效。这起诉讼将于今年6月正式开庭审理。

有分析认为,此次事件是德国长期以来关于“效率和公平孰者优先”争论的最新一例。德国在二战后确立的“社会市场经济”中的“社会”二字强调其在分配和社会福利等方面具有相当程度的公平性,反对自由放任的美式资本主义。柏林官方作出这一决定时,未明说的逻辑便是这些住房通过网络短租带来的丰厚利润使得房主不再愿意长期租给那些没有多少钱、但又真正需要住房的人,从而造成社会不公。
