Cases of corruption and land requisition compensation: less than hundred km road down 7 cadres

贪污征地补偿款案:不足百公里路段撂倒7名干部

  随着国家对高速公路建设投入的加大,国有耕地、农村集体耕地经常被征用,征地补偿款这块“肥肉”成了一些“苍蝇”的“眼中肉”。内蒙古自治区科左中旗检察院近年立案查处了两起贪污征地补偿款案。这两起案件均于2009年发生在大广高速公路双辽至通辽(全长93.6公里)同一施工标段,涉案的七名干部分别来自两个相邻的镇、场。


  案例一:巴彦塔拉镇烧锅王村原党支部书记王井春、原村主任万志国、原会计孙晓辉,在负责统计上报被征用耕地过程中,发现本村与吉林省卧虎镇存有权属争议的耕地被征用20亩。三人商议后未作声明、欺上瞒下,以4个未被占地户的名义上报,骗取补偿款29.66万元。


  案例二:白音塔拉农场六分场原党支部书记吴白拉、原场长包石桩,在负责统计上报被征用耕地过程中,发现六分场国有机动耕地被征用139.23亩。两名六分场干部向负责确权审核的场部原副场长张东升、综治办原主任吕颖反映此情况时,吴白拉提议不予公示、私分补偿款,四人一致同意,并以13个未被占地户的名义上报,骗取补偿款117.28万元。


  科左中旗检察院分析认为,征地补偿款这块“肥肉”之所以经常被“苍蝇”盯上,主要有以下几个原因:


  一是管理失察,为他们提供了虚报冒领空间。在征地过程中,高速公路管理部门只依据耕地面积及类别核发补偿款,不需要掌握耕地的权属及性质。也就是说,被征用耕地的承包户是谁?被征用耕地是不是机动地?高速公路管理部门不需要掌握。这就为上述七名干部提供了虚报冒领的空间。他们明知自己的行为可能触及法律,但仍不计后果,铤而走险。


  二是缺乏透明,为他们提供了暗箱操作空间。上述七名干部在统计征用土地数据过程中,均以未被占地户的名义上报,而且大部分为“户在人不在”。因为他们知道,无论是机动耕地还是有权属争议耕地,本村村民或本场职工都非常清楚位置和底数,只有不予公示,只有以“户在人不在”的名义上报,才能瞒天过海。上述两个镇、场在开展征地补偿工作中,大多只向群众公开相关政策,具体的征用耕地的位置和底数都不公开,或者公示不深入、不彻底。这种不透明的公示,为他们提供了暗箱操作的空间。


  三是权责不清,为他们提供了自由裁量空间。上述七名干部中有的负责确权审核,有的负责统计上报,但由于上级主管部门为了征地补偿工作尽快完成,往往让负责确权审核的人参与到统计上报工作中去,这样就为他们提供了自由裁量的空间。同一个工作人员参与多个基础工作环节,必然造成权力集中。在利益的诱惑下,他们就会利用手中的权力谋取私利。(徐涛)
