著名慈善家、中国裸捐第一人余彭年终于可以安眠了。
2016年5月2日，正是余彭年离世一周年祭日。这一天，长孙彭志兵和次子彭亚凡在余老墓前代表两家人告慰余老：家人会坚决执行他的意愿，实现他对社会百亿祼捐的承诺。
而就在半年前，次子彭亚凡曾质疑余彭年遗嘱的有效性，并引发长孙彭志兵向香港高院起诉，要求法庭证明遗嘱有效。遗嘱的核心内容正是余彭年欲将全部身家用于慈善事业。
这一桩“百亿遗产案”一时间沸沸扬扬。中国裸捐第一人能否兑现承诺引人瞩目。
几天前，此案终于尘埃落定，画上了一个圆满句号。

对于余彭年来说，应该没有比这更好的告慰了。
而这样的一幕，对于半年前对薄公堂的彭志兵与彭亚凡来说，亦是期待已久。
早在2010年，有着“中国第一慈善家”美誉的余彭年就曾公开表示，要将全部身家捐出作慈善用途，不会将财产留给子孙。之后，他还立下遗嘱，表明祼捐决心，彭志兵被定为遗嘱执行人。但是彭亚凡及其家人对遗嘱的部分内容提出质疑导致遗嘱执行受阻，彭志兵于2015年12月11日，以个人及余彭年慈善信托惟一受托人的身份，正式向香港高院起诉，要求法庭证明遗嘱有效，并撤销阻挠承办遗产的知会备忘。
当时，彭志兵对外称，状告叔叔他也很心痛，但是，他更担忧外界怀疑祖父祼捐的真实性。
彭志兵从小在祖父身边长大，感情很深，也深受祖父一言一行的影响，他多次在各种场合明确表示要不折不扣地全力履行祖父的祼捐夙愿。

老人的决心
为了更好地确保祼捐得以执行，余彭年还于2011年7月20日在律师及医生的见证下订立了遗嘱，表明将名下财产划入余彭年慈善信托。
在中国的慈善事业图谱上，余彭年举足轻重。
“儿子弱于我，留钱做什么？儿子强如我，留钱做什么？”在深圳的彭年酒店里，有这样一幅余彭年的亲笔题字，告诫有钱人要做慈善，不要将钱给子孙。这一手好字引人深思，也从一定程度上解释了余彭年生前身后始终如一做慈善的缘由。
余彭年原名彭立珊，生于湖南，于上世纪50年代末到香港打拼，从事地产起家。在香港，他因拥有著名地标理想酒店及曾豪言捐出李小龙故居而为港人所识；在内地，他的彭年酒店收益也作慈善用途。
余彭年就这样一桩桩做着好事。事实上，余彭年在内地的慈善事业早在上世纪80年代便开始了，涵盖医疗和教育等方面。他兴建救护中心和学校，开展白内障医治，广为人知，因长年致力于慈善事业，余彭年连续五年蝉联胡润慈善榜榜首。
余彭年不打算终止他的慈善事业，无论生前还是身后。于是，对于旗下的近百亿港币资产，余彭年早就做了周密的祼捐安排。
早在2009年1月16日，他成立了余彭年慈善信托，该信托的目标即管理旗下资产，当时明确的方向则是将资产经营收益全部用于慈善事业。
余彭年慈善信托属于家族信托。这种家族信托可降低继承的风险，如果离婚分家产、意外死亡或被人追债，这笔钱都将独立存在，不受影响。这就意味着，余彭年早已确定资产独立性，不受干扰地用于慈善事业。
为了更好地确保祼捐得以执行，余彭年还于2011年7月20日在律师及医生的见证下订立了遗嘱，表明将名下财产划入余彭年慈善信托。
如此种种，可见余彭年的裸捐决心与细致考量。而后来的案件风波，把余老的心愿整整推迟了一年。

随着案件风波的尘埃落定，彭年公益事业也将逐步恢复正常。余彭年慈善基金会给国内高校的捐款以及光明行动已在进行及洽谈中了。
百亿遗产案件让彭亚凡、彭志兵叔侄二人经历了曲折并漫长的半年。
网络上一边倒的支持余老祼捐之声此起彼伏。
“这是何等的不朽功勋，何等的慈悲之心，又是何等的胸襟、格局与气象，余老好伟大！”
“这肯定是余彭年先生不愿看到的局面！”

凡此种种，对于彭亚凡与彭志兵来说，是同样的压力。
在此期间，双方进行了多次的沟通，通过一次次交流双方对余老的善心有了更深刻的体会，并逐步达成了共识
——那就是双方都有责任将余老的大爱传承下去。
今年4月22日，彭亚凡正式向香港高院提交了关于余彭年遗嘱内容的不抗辩答复书，表明彭亚凡及家人不再质疑遗嘱有效性。
双方还选择在余彭年一周年祭日这一天，共同来到墓前，将这一结果告慰老人，是为对此风波的最终交待，同时也召告所有关心余老的人，全家人会坚决尊重和执行余老的遗愿，把他的慈善精神传承下去。
“这样的结果对余老来讲是幸事，对他的家人来讲是幸事，对中国公益事业更是幸事。”余彭年慈善信托首席顾问徐滨感慨道，这个圆满的结果，即是余老的家人，也是全社会关心余老公益事业的爱心人士们对余老在天之灵最好的慰籍和最崇高的致敬。
随着案件风波的尘埃落定，彭年公益事业也将逐步恢复正常。余彭年慈善基金会给国内高校的捐款以及光明行动已在进行及洽谈中了。
至此，余彭年对社会的承诺终于得以实现。
