涉黄会所藏身豪华公寓，借大众点评、美团网以团购方式销售色情服务。近日，海淀公安警方端掉该涉黄团伙，抓获10名涉黄人员。昨天，两家团购平台回应，已经第一时间对涉案商户进行了下线处理，同时对两平台的相关商户信息进行了重新排查，严格杜绝此类提供违法服务的商户。
昨天，美团、大众点评平台回应称，了解情况后，两平台第一时间对涉案商户进行了下线处理，两平台将保留追究其法律责任的权利。与此同时，两平台第一时间积极配合警方调查取证，相关人员也积极配合警方进行笔录等工作。
两平台表示，对于平台上的商户一直实行严格的监管，通过技术手段与人工审核相结合的方式，对新上团单、修改团单等信息都进行品控、风控双重严格把关，一经发现商户确有违规情况，公司秉持“零容忍”的准则对其进行相应处理与处罚，涉及违法犯罪部分的将向公安机关进行举报。

若明知违法而提供帮助，互联网公司或构成共犯
北京隆安律师事务所尹富强律师表示，根据《中国互联网管理条例》第十五条的规定，互联网信息服务提供者不得发布“散布淫秽、色情赌博、暴力、凶杀、恐怖或者教唆犯罪的”内容的信息，不得发布法律和行政法规禁止的内容。而且根据该条例第十六条的规定，若互联网信息服务提供者发现其网站传输的信息明显属于本办法第十五条所列内容之一的，应当立即停止传输，保存有关记录，并向国家有关机关报告。
但若互联网信息服务提供者明知发布的内容违法或为实施犯罪行为而提供发布等帮助，则有可能构成共犯。
尹律师表示，当前我国互联网方面规定还不完善，另外借助互联网违法或侵权的成本太低也是重要的因素之一。相关部门应该重在制定规则，要让违法、侵权之人付出较大代价，让维权之人有维权积极性，这需要较为严格的法律保障。
