互联网观察人士、版权律师林华表示，从法律上讲，网盘是信息网络传播的一环而不是全部，提供网盘服务的网站提供的不是内容本身而是存储内容的技术服务。
林华解释，“我本人把信息上传到网盘，网盘服务商提供了存储的服务，然后我通过网站服务商提供的存储服务向互联网公众来传播我在网盘上上传的内容，这样是一个完整的过程。而网盘在这个过程中只是其中一个环节，就是存储，如果要确定网盘的法律责任，网盘服务商它提供的服务，仅仅是存储服务这一条应该明确，就不应该说整个链条中，包括各种不同的行为包括上传、存储、传播，所以他这一系列的过程中，每一个环节都有可能存在独立的责任。”
林华认为，一个比较合理的解决方案是对利用网盘进行传播的行为视同网络传播和提供内容服务进行监管，但对纯粹非公开的私人网盘存储，应从法理上只能实施形式监管，但不能直接进入私人空间进行审查。“如果是一个单纯的网盘服务的提供商，它其实把网盘提供存储作为一个完整的商业模式，就是用户可以提供储存，同时网盘的服务商又为用户通过网盘存储内容的传播提供了帮助，比如说我帮你去做推广，那么在这种时候这个网盘提供服务商它提供的服务，就不仅仅是纯粹的存储服务，在这个时候如果说被传播的内容出现了违法违规的，这个时候就要看，这个网络服务的提供商，它在内容传播的过程当中参与度有多少。”
