原标题：工程占地千余古枣树被移栽 国内首起古树公益诉讼立案
新京报快讯(记者王硕)2014年初，因工程占地需要，河南新郑市薛店镇花庄村千余株古枣树被当地政府移栽。认为涉嫌环境侵权，中国绿发会将花庄村委会、薛店镇政府等5政府部门诉至法院。5月6日，新京报记者获悉，该案已获郑州市中级人民法院立案。据了解，该案是国内古树名木环境公益诉讼第一案。
因工程需求千余古树遭偷伐
新郑是红枣故乡，种枣历史最早可追溯到8000多年前的裴李岗文化时期，当地大面积生长的几百年树龄的古枣树林，使新郑及周边形成了稳定的古枣树人文和自然生态环境。2010年，新郑市人民政府曾提出“对位于新郑市薛店镇花庄村1023亩古枣树实施文物级保护”，在该保护区内，百年以上的古枣树多达17660株。
2014年初，这种“文物级保护”因工程建设需求发生了变化。据当地媒体报道，2014年1月16日晚，花庄村委会及薛店镇人民政府带着采伐施工队数十人，在花庄村古枣树林地采伐古枣树千余株(后有关部门认定是1870棵)，偷伐行为被村民发现后阻止。
今年4月27日，中国绿发会就此提起环境公益诉讼，要求相关政府部门停止继续实施毁坏古树、损害环境的行为，对砍伐造成的人文及自然环境损失予以赔偿，并向公众赔礼道歉等。
诉状称被移栽古树大量死亡
中国绿发会在诉状中称，此事经媒体报道后，当地政府将采伐的古枣树以“移植”名义移入新郑市薛店镇王张村中华古枣树园，进行所谓的“移栽”。但由于采伐时不是以移植为目的，采用破坏性毁灭性的方式挖掘古枣树，之后“移植”“移栽”时也未按照规范操作，导致被“移栽”古枣树大面积死亡。
中国绿发会认为，花庄村委会、薛店镇政府等部门非法采伐和毁坏古树林木，破坏了当地几百年以来已经形成的生态环境，严重损害了社会公共利益，应当承担相应的法律责任。
5月6日，中国绿发会收到了郑州市中级人民法院发出的“受理案件通知书”。
据了解，这是环保公益组织就古树名木保护所提起的首起环境公益诉讼。中国绿发会副秘书长马勇表示，此案也是民间环保组织通过民事公益诉讼纠正并规范政府行政违法行为的一次尝试。
