据中国新闻网报道，记者通过淘宝搜索“社保代缴”咨询到一家淘宝店铺，客服人员回应称，个人社保代缴主要面向离职换工作期间社保不想断缴、没有单位缴社保的人群，只要提交基本资料，每月交19.9元的五险代缴费用，社保缴纳就像网上购物一样简单，可以线上付款。
还有一家通过微信代缴社保的公司客服对记者表示，该公司“由中华人民共和国人力资源和社会保障部认证许可，社保资金由招商银行监管，以微信端便捷操作，满足个体社保缴纳需要”。个人社保代缴的服务费最低是80元/月，新注册的客户目前还会赠送30元的代金券，可以直接在微信端提交订单进行付款。
记者进一步调查发现，在网上办理社保代缴，代缴公司并不会与需求者签订劳动合同，而是要求签订一份服务协议，协议中均明确强调，双方不存在劳动关系。
也就是说，网上这些提供社保代缴服务的公司，实际上是提供的一种挂靠代理公司缴纳社保的服务。那么，这种网上代缴社保的服务靠谱吗？是否合法合规？
对此，人力资源和社会保障服务部门给出的回答是，职工必须签订劳动合同，跟用人单位存在劳动关系，才能通过单位缴纳社会保险。双方没有建立劳动合同关系，而是通过挂靠代理公司来缴纳社保，这是不合法的，也是政策不允许的。对于外地户口的人员在北京如果没有工作单位，是无法上社保的。而没有工作单位的北京本地城镇户口人员则可以通过人才服务中心或者职业介绍服务中心来参加社保，但只能参加养老、医疗、失业三险。
