现状

7000人从业每天21万个电话

记者数月前到香港工作生活,办了本地手机号,果然很少接到垃圾短信,但却经常接到陌生人的推销电话,有些甚至能叫得出我的名字。电话推销手法五花八门。有的声称代表某银行,可安排贷款,但事后发现对方是中介公司,根本未获银行授权。不少境外来电,显示出2及3字头的香港本地电话号码,且经常换号,追查相当困难。有的冒用知名机构,容易让人轻信;有的巧舌如簧,死缠烂打。

香港人一年会接到多少个促销电话?特区政府商务及经济发展局(商经局)委托顾问公司,最近对拨出促销电话的业界进行调查,受访的42家公司,雇人每天共打出约21万个推销电话。该项调查还访问了1000名居民,96%受访者认为促销电话造成滋扰或带来不便,有35%受访者一周接到6个以上的促销电话。

负责调查的顾问公司估计,目前香港约有7000名雇员从事电话促销工作,之前的同类调查则显示,从业者数以万计。业界人士透露,香港以此为生计的电话中心约有2500家之多。随着电信成本下降,一些电话营销中心转到内地,继续给香港机主拨电话。

早在2014年,香港个人资料私隐专员公署也委托香港大学做了同类调查,结果显示,逾40%受访者认为促销电话涉及使用其个人资料,62%不满对方可直呼其名,逾40%促销电话来自机主曾光顾的公司或商家。

个案

噱头诱人电话促销易成消费陷阱

打电话这种互动模式,让销售人员可实时掌握顾客的反应,见机行事,促成一些成交。但推销员往往为了追求业绩无所不用其极,有的以优惠、噱头先引人兴趣,继而推销真正的货色,有的隐藏、捏造商业要素,哄人购买其商品或服务。

维权机构香港消费者委员会(简称消委会)接获有关“失实电话推销”的投诉,每季度都有几十宗。消委会在其网站、刊物上经常公布一些案例,供市民分析借鉴。

胡先生是D银行客户,因财务困难,每月只能缴付信用卡最低还款额。自称D银行审批部职员的K致电他,介绍一个“加分减息”计划,说可帮助客户提升信贷评分,减低利息,还可获批另一张信用卡,不过胡先生信贷评分太低,无法申请加入该计划,可先参加H财务顾问公司推出的一项债务纾缓计划以提升评分。在K的多番催促下,胡先生同意向H公司支付3万多港元的顾问费,以提升信贷评分。

一个月后,胡先生与D银行通电,得知该行从未推出“加分减息”计划,再核实K提供的联络电话,原来K不是D银行的职员。被骗的胡先生要求H公司取消合约及退费,消委会也协助联系,H财务顾问公司强调,计划内容及收费已在合约中列明,既然签署了,不能退款。消委会只能建议胡先生寻求法律途径解决。

一家专业体检公司的雇员明知一名前顾客已表明拒绝接受促销宣传,仍致电其手机进行推销,机主发电邮要求对方停止直销。但体检公司职员仍致电推广一项身体检查服务组合,机主向个人资料私隐专员公署投诉,案件转介至警方跟进。2015年11月,该体检公司被屯门法院判罚款1万港元,涉事公司表示服罪。类似案例已有多起。

规管

全面取缔政府业界都有顾虑

香港立法会通过的《非应邀电子讯息条例》于2007年12月生效,电邮、传真、预先录制的话音讯息、短讯或多媒体讯息等,均受规管。向政府登记号码的方法很便捷,拨打热线1835000即可。人们不得向已载于“拒收讯息登记册”上的电话、传真号码发送商业电子讯息,如违反,第一次定罪最高可罚款10万港元,最高罚款50万港元。

据香港电讯局2014年底的统计数据,办理拒收登记的电话号码有270多万个。条例实施后,电讯局收到的举报,从2008年的8000多宗大幅下降至近年每年约2000宗。可见,法例基本遏制了垃圾短信、事先录音的广告电话等。

但该条例的规管范围未列入“人对人促销电话”。原因主要是当年立法时,政府考虑到这类电话涉及许多港人和公司的生计。所以,尽管香港社会多次提出解决这个问题,香港政府仍未下决心。

顾问公司做的调查今年4月发布后,香港商经局局长苏锦梁在立法会表示,全港有7000人从事电话销售,又有20%受访公司表示如果立法规管,销售量会下跌,很多企业依赖电子通讯作为市场推广工具。是否加强规管,要平衡滋扰市民、就业问题及中小企业营商环境。议员马逢国认为,应双管齐下,一面果断立法,同时想办法协助业界转型。民建联议员谭耀宗认为,促销电话滋扰大、成效低,从业人数亦在萎缩中,但不宜“打烂人家饭碗”。

代表业界的香港客户中心协会执行总监陈建年在电台节目中表示:认同规管随机拨打的促销电话,但不能一刀切,避免影响太多人的饭碗。

防范

法律空当业界自律市民自保

看来,真人促销电话禁不禁、如何禁,要看未来的咨询结果。在此之前,香港政府引导业界进行自律。自2011年6月起,较多电话促销的金融、保险、电讯及电话促销中心4个行业,订立并公布了《业界守则》,规定机主如向促销公司提出拒绝接收促销电话,业者应该遵从。香港银行公会去年9月发布的守则载明,各零售银行在进行电话促销活动时,要提供员工编号、直线电话或内线电话号码,让公众核实身份。有的机构自我限制了致电的时间段,当得悉机主身在海外,应立即挂断。

面对不请自来、从早打到晚的推销电话,不少港人另谋对策,自求多福。多家电讯商已推出阻截滋扰来电的服务,在坊间,几年前就有IT达人收集资料,在网站上公布“广告电话黑名单”,网友编写智能手机应用程序,下载后可拦截、过滤一些无来电显示及已被举报的促销电话号码,下载者众多。但有的商家不断更换号码,推销来电仍是无孔不入。

香港消委会、警方和个人资料私隐官员,经常提示市民,防范电话推销的陷阱,如在会员登记、产品优惠及问卷调查等填写个人资料时,应谨慎鉴别其用途,避免不经意间“露底”。遇到来历不明的电话推销时,谨记“便宜莫贪”!不要因“怕烦”、“不懂拒绝”而仓促答应成交,切勿随便答应签约、付款或续约,别以为答应后可轻易推翻交易。如果怀疑对方身份,核实时不要碍于情面或怕麻烦。
