近日,在互联网上颇有名气的漫画家姜晓晨(微博ID:晓晨兽)与原东家夏天岛合同到期,双方对于合同期间作品著作权归属问题产生分歧。

在这一个个纠纷的背后,因为行业发展过快,原有的漫画行业规则已经不能适应互联网环境。在大量资本涌入、IP概念过热的情况下,越来越多的漫画家开始重视自身价值与合法利益。

“晓晨兽”陷版权难题

由于创作周期长,很多漫画家喜欢将自己辛苦打磨出来的作品称为“孩子”。

4月12日下午1点左右,漫画家姜晓晨在微博上发表一则道歉声明,“自己生的孩子已经不属于自己”,因为合同解约,她离开东家夏天岛后,按照2009年签订的合同中规定,包含《开封奇谈》在内的诸多作品,著作权归属于公司,已与她个人没有关系。

这样一封道歉声明在漫画界掀起了一场波澜,大量漫画原创作者和读者在微博表示对姜晓晨予以支持。姜晓晨表示,当年自己法律意识太淡薄,并没有意识到合同有何不公。对此,有人表示,即使意识到了,很多作者在初出道时因为没名没钱,只能签署一些带有明显不公的合同。微博上知名漫画家夏达、凌宇沫、白晓等均发言予以支持。

“没什么可感叹,年少无知,不懂事而被欺负,双方都付出了不可挽回和不可计算的成本。”漫画作者、云漫时代CEO吴君对记者表达了截然不同的观点,他认为,著作权归为公司本身无可厚非,签约新人时,公司是带有风险进行扶植的。

“作为新人来说,希望有公司平台来培育自己;而动漫或者文化创作类公司也需要补充新鲜血液,两者是契合的。公司运营作品,并不是把作品在网络发布就完事,它还需要匹配资源,线上线下宣传,多方位立体运作,才能增加作品的成功率乃至成为当红作品。”业内人士认为,如果著作权不归公司的话,很可能出现作者在其盈利后单飞的风险,那么这样对于整个动漫产业发展也不利。

律师:重大误解可以撤销

上海市申达律师事务所喻劼律师在接受采访时表示,在未实际看到晓晨兽与夏天岛合同前,他虽然无法对合同本身是否存在所谓的“不公正”情况做出评价。但相关合同如果确实存在“显失公平”的情形,应当鼓励漫画作者去维护自身的合法权益。

在实际操作中,平台公司获得或者使用美术或文学作品主要是通过与原作者签署三种合同:即著作权转让合同、作品许可使用合同或者作品委托创作合同。这三者占据了现有业务模式的绝大多数。

在著作权许可使用合同的情况与著作权转让合同中,作者与平台的主要争议焦点还是在于许可使用的范围是否足够明确。根据著作权法的规定,如果合同中没有明确许可或者转让某项权利,应当视为著作权人没有转让或者没有许可使用。

喻劼强调,根据我国合同法的规定,合同可能存在无效的情形,也可能由于重大误解、显失公平、乘人之危等情况而可以撤销。所以,并不能说作者和平台公司的合同约定了著作权归平台所有,就一定会得到法院支持。

“不对等合同”仍很常见

“我周围的很多朋友遇到不平等条约,比如某平台惊天动地的霸王条款,不允许你用同一个笔名到其他平台发表作品;为作品支付低廉价格,也不给你推广;签了一个作品,还要把相关的前传、后传、个人传、续集等都签走。”对于当下漫画作者的生存现状,吴君认为,不对等合同在圈内仍然很常见。

根据易观智库提供的数据,漫画作者的队伍近两年迅速扩容。2009年上线的原创漫画网站“有妖气”已经有超过2万名漫画作者常驻创作,4万部以上漫画作品正在连载。腾讯动漫成立于2012年,截至2015年6月,腾讯动漫网络平台作品总量超过2万部,投稿作者总数超过5万人。

从新手成长为老手需要一年半到两三年不等的时间,所以过去10个新手之中,六七个都会放弃,如今资本操作下,频率加快,一年左右即可从新手成为一名成熟的作者。”据吴君介绍,目前自由漫画作者主要收入依旧是稿费、版税和改编的分成。公司旗下的则有薪资、奖金、社保金、作品报税、改编分成等构成。在新人还没出名、尚未有作品的时候,公司也给予薪资,缴纳社保。

“漫画新手的薪资大概是在3000~4000元的水平,如果已经有好作品的话,漫画作者就相当于白领阶层,平均月薪8000元以上,上万也不是难题。目前来看,收入不算低。”吴君说道。

虽然从业者收入提升很快,队伍也发展很快,但很遗憾的是,喻劼表示,自己接触过不少漫画作者,大部分在知识产权方面的法律知识还比较欠缺。关于作品著作权的取得,例如有的作者会想当然认为既然创意是我的,那么作品的著作权自然是我的,不需要保护和证明,这造成了后续维权会遇到比较大的障碍。

姜晓晨事件的出现是好事,说明大众对于作品著作权越来越重视,关注创作领域的人越来越多。“可能旧有的模式或合作方式不太适合当前了,需要改革,并均衡各方利益。

同时,喻劼也表示,不能忽视动漫平台的重要性。“如果我们去看日本和美国的动漫产业,就会发现平台、制作委员会这样的市场参与方在动漫产业中扮演着至关重要的角色,而这也是我国动漫行业未来的发展趋势。”
