  网民普遍认为,当地政府巧妙地把公路变成了风景名胜区,是在“拦路收费”。长期从事旅游规划、风景道研究工作的北京交通大学教授余青表示,目前,公路法在公路变成景区方面没有明确规定。


  根据《河北省风景名胜区条例》第八条,设立市级风景名胜区,由县(市)人民政府提出申请,设区的市人民政府住房城乡建设(园林)主管部门组织论证提出审查意见后,报设区的市人民政府批准公布,并向省人民政府住房城乡建设主管部门备案。张家口政府称,“草原天路”于3月25日正式被市政府批复为市级风景名胜区。在这一点上,张家口将“草原天路”设为风景名胜区是合法的。

  中国未来研究会旅游分会副会长刘思敏认为,张家口需要制定切实可行的方案,保障非旅游观光车辆免费通行。对走完全程的车辆,可通过规定这些车辆的通过时间,采取起点买门票、终点退门票的方式。

  刘思敏认为,“因为公路本身具有公益性,变身景区收取门票的合理性仅仅在于当地是国家级贫困县,政府无力为外来游客提供旅游公共服务,不得不向游客收费以支付成本,所谓‘取之于游客,服务于游客’,最基本的原则是基于成本定价,而不是成为地方政府或企业牟利的工具。”


  对于每人50元的定价,虽然当地政府对成本构成给予了解释,程序上也看似合法,但网民质疑强烈。记者就收费问题致电河北省物价局,经营收费处相关负责人表示,张北“草原天路”收费在程序上是合规的。至于收多少,张北县是扩权县,有定价权,河北省物价局在听证会后已经备案。


  刘思敏认为,要按年度公布经过第三方审核的财务报表,使其经济运行置于全民监督之下。对价格实行动态管理,根据公开、可信的财务报表,决定下一年度价格调整方案,确保门票收费主要用于景区开发、管理和维护,而不是当地所谓的“收支两条线”。

  “但从贫困地区的现实情况考虑,短期内采取这种方式,可以理解,但必须平衡好长远发展与近期问题之间的矛盾,不能把门槛设得过高,否则有可能导致‘杀鸡取卵’的后果。”刘思敏说。


  余青表示,有关草原天路由“路”变为“景区”的讨论,实际上折射了在自驾游的时代,风景道——这种新生事物如何认定,如何进行有效建设、管理和维护,如何在保护与发展之间找到平衡点等一系列问题。需要从顶层设计角度,对现有道路制度进行修改和完善,将风景道纳入到制度中来,这样才能为风景道健康发展提供制度保障,并促进以风景道为载体的旅游景区和目的地的可持续发展。
