检方指控
十年间利用职权牟财
今年48岁的郭向东大学文化程度，历 任北京市昌平房地产开发有限责任公司党委书记、总经理，北京铭嘉房地产开发有限公司董事长、总经理，昌平区百善镇委员会党委书记，回龙观镇委员会党委书 记。2015年1月30日，郭向东因涉嫌受贿罪被刑事拘留，同年2月12日被逮捕。
据指控，郭向东于2004年至2007年间，利用其 担任昌房公司党委书记、总经理的职务便利，伙同北京浴龙温泉有限责任公司法定代表人裴然涛（另案处理），在昌房公司开发富松居住小区项目的过程中，以支付 虚假“中介费用”的名义，将昌房公司资金2000万元转入浴龙公司账户，予以侵吞。
此外，郭向东于2004年至2014年间，先后利用 其担任昌房公司党委书记、总经理，铭嘉公司董事长、总经理，百善镇党委书记，回龙观镇党委书记的职务便利，在房地产开发、工程承揽、土地项目开发、拆迁等 事项中为他人牟取利益。为此，多次收受他人给予的财物共计1400余万元。郭向东将受贿所得的一套房产出售，售房款2360万元已追缴。
检方认为，郭向东利用职务便利，伙同他人侵吞公共财物，数额特别巨大，应当以贪污罪追究其刑事责任；郭向东利用职务便利，非法收受他人财物，为他人牟取利益，数额特别巨大，应当以受贿罪追究其刑事责任。
法院庭审
当庭认罪愿接受惩罚
庭审中，郭向东表示认罪，称没什么可辩护的，既然犯了罪，就要接受惩罚。最后陈述时，他深深忏悔，称父母年迈且身体不好，不知出狱后还能否尽孝心，同时也对不起妻子和孩子。
郭向东的辩护律师牛燕军认为指控数额有些误差，有些细节不清晰，需进一步核实，为郭向东做罪轻辩护。据牛燕军说，2014年年底，纪委找郭向东调查一笔 与他有关的50万元钱款，郭向东如实供述并主动交代其他犯罪事实，具有自首情节。此外，他还提供了其他关联案件的线索，有重大立功表现。律师还提交郭向东 荣立二等功证书以及单位出具的工作成绩突出的证明，证明其一贯表现良好。同时，郭向东积极退赃，依法具有从轻或减轻处罚的情节。
不过，检方并未认定郭向东自首，称没有纪委出具的书面材料证明。对于律师申请调查的请求，法官回复庭后核实。昨天下午4点，庭审结束，此案将择日宣判。
辩护律师
“交代后他反而轻松了”
庭审后，牛燕军表示，郭向东贪污的2000万元并未用于个人挥霍，主要都帮着弥补单位以前投资失败的一些窟窿等。受贿的两套房子，一套空着，另外一套位于西城区的房子由妻子带孩子上学居住。郭向东在纪委调查时卖掉的那套房产，2004年收受时仅价值百万元。
“他从始至终都是认罪的，但称有些事情是不得已为之，是他法律意识淡薄造成的。交代问题后，他反而轻松了。”牛律师说，郭向东没有索贿情节，钱都是别人在得到帮助后主动给的。他也退还过，但对方又送回来。碍于情面和朋友关系，他只好收下。
据牛律师说，郭向东的妻子得知丈夫涉贪非常意外，因郭向东未将钱拿回过家里，其妻也以为自己住的房子是郭向东租来的。案发后，她退赃态度很积极，其哥哥也愿意卖房帮助退赃。
