　　新京报快讯（记者林斐然 实习生王春晓）5月13日上午，海南省高级人民法院发布消息，称与陈满就国家赔偿问题达成赔偿协议，向陈满支付国家赔偿金275万余元。陈满曾于3月14日向海南高院提出约966万的国家赔偿申请。

　　1992年12月25日夜，海南海口发生一起杀人放火案。案发后，曾在此租住的陈满被锁定为凶手，并于1999年二审获判死缓。今年2月1日，浙江省高级人民法院依法对陈满故意杀人、放火再审案公开宣判，认定事实不清，证据不足，撤销原审裁判，宣告陈满无罪，当庭释放。

　　3月14日，陈满向海南高院提出966万元的国家赔偿申请。3月30日，海南高院依法组织公开听证会，听取赔偿请求人陈满的意见。5月13日，海南高院与陈满达成国家赔偿协议，向陈满支付国家赔偿金2753777.64元。

　　新京报（微信ID：bjnews_xjb）记者注意到，陈满此前申请的966万余元国家赔偿中，包括人身自由赔偿金185万元、误工费370万元、精神损害抚慰金300万元、医疗费和后续治疗费10万元，以及23年申冤费用支出100万元。而此次双方达成的赔偿协议主要包括人身自由赔偿金185万余元，和精神损害抚慰金90万元。

　　陈满案代理律师王万琼表示，人身自由赔偿金和精神损害抚慰金均属于国家赔偿的明确项目，误工费等由于未被明确规定，故不予支持。陈满已蒙冤23年，时间上等不起，加上父母年事已高，考虑到国家赔偿方面的实际现状，尽管不尽如人意，还是认可和接受了这一结果。

　　5月13日中午，陈满接受新京报（微信ID：bjnews_xjb）记者采访时表示，考虑到时间上“等不起”，父母也年事已高等因素接受了国家赔偿协议，但对具体数额表示遗憾，认为这笔钱不足以弥补自己23年的美好青春。

　　对话 | 陈满：希望尽快开始新的生活

　　新京报：这个金额是什么时候定下来的，中间有经过协商吗？

　　陈满：这个是我们昨天（5月12日）上午决定的，中间经过了好几次协调，我们去了两次，听证会开了一次，然后我们又去了一次，昨天算是第二次协商。

　　新京报：赔偿数额和之前提出的要求差距比较大，对这个结果你感到满意吗？

　　陈满：按目前的赔偿法来讲，主要是人身自由赔偿和精神赔偿，但是其他的合理赔偿，比如误工费就没有明确的规定，他们也不好掌握。我们觉得赔那么少非常遗憾，包括我们的申诉费应该考虑到赔偿金额里面，支付给申诉人，而且他们剥夺了我挣钱的权利，那么也应该要支持赔偿的。

　　而且案子对一个人的精神损失是非常巨大的，不是说一夜之间就能恢复。举个例子，我同学基本上都有小孩了，小孩很多都工作了，甚至个别的还有孙子了，那我现在还是孤身一人。我要是再结婚的话，还得有个过程，还要一年两年，那过了一年两年，人家的小孩都长大了。 就算按我们以前申请的九百多万的赔偿，也不足以弥补，你付出了二十三年青春，那是人生年华中最美好的时光，这个你补不了，我的后代你也弥补不了。他们在外面过幸福的生活，和他们比我就是一个穷人。

　　但是现状就是这样的，我们也只能认可。我已经耽误了23年，必须尽快融入社会重新开始。这件事经过了很多时间，也花了我很多精力，我觉得父母年纪也大了，他们也是老革命，他们也觉得按目前的司法现状要为国家考虑，所以我们从各个方面来考虑觉得认可，希望尽快解决这个问题，尽快开始新的生活。

　　新京报：你之前似乎要求海南高院作公开道歉，但最后没有提到这一点。

　　新京报：你想过两百多万赔偿到手以后做什么吗？

　　陈满：这笔钱做什么我也考虑过，但是我和世界已经隔绝23年了，现在的世界和二十年前相比发生了天翻地覆的变化，无论是从经济发展还是从人们的思想，可能都有很大的不同，所以我还必须融入社会、了解社会，和这个世界接轨，总要会点什么才能起步吧。我的想法就是可能到明年的时候去用来创业吧，应该是用这笔钱来做投资。

　　新京报：3个月前联系你的时候似乎对狱外的生活还不太适应，那现在呢？

　　陈满：现在相对地说有些进步吧，因为有些东西用的时候还是感觉很多东西还不了解，我们以前就没有手机，根本就不知道有微信，现在可以用微信了，交流起来也是比较方便的。
