　　一幅贪官的“雅贿品”，创下南通市中级人民法院司法拍卖平台的最高价纪录。

　　这幅《诸君一笑图》落款为当代著名画家黄永玉，拍卖前经专家鉴定为赝品，起拍价仅为3100元，却在5月3日拍卖时被众多竞买人激烈争夺，经过180多次的加价，最终被一名竞买者以10.09万的价格拍得，溢价率高达32倍多！

　　有没有搞错，出高价来买赝品，这是怎么回事？有分析称，虽为赝品，但也具备一定的观赏价值，竞买者或许看中了这方面的价值。

　　政知道注意到，这幅画的主人是江苏省盐城市政协原副主席徐超，已因受贿被判刑。2011年，徐超妻子在家中收受了某公司负责人所送的画。身陷囹圄的当事人一定没有想到，这画竟然是赝品。

　　2009年8月27日，被网民称为“戴包包”的温州经济技术开发区管委会原主任戴国森被抄没的22只名牌包等赃物被公开拍卖，也曾引发市民疯狂抢购，这场温州史上最热闹的拍卖会吸引了690多人次参与竞拍，拍品成交率100%，短短1个小时，总共114项物品拍出117.8万元！

　　这位“戴包包”的拍卖会现场中，也有书画，落款为著名书画家沈鹏、范曾等人的近20幅“名家书画”曾备受关注。虽然拍卖行人士及有关书画评估专家明确称：除齐白石的“一只虾”是真品外，其余“全是赝品”，挂出的每件参考价基本上低于200元，最低的甚至只有40元。

　　一张画成为控辩双方争议焦点

　　在热衷接受“雅贿”的贪官中，字画、玉石都属高频词汇，比如原铁道部部长刘志军收受字画、玉石等物品近200件，价值1300余万元；再比如在重庆司法局原局长文强的赃物展示会上，就展出了36件现代工艺品、9件文物和69幅字画。

　　值得一提的是，在当年文强受审的法庭上，控辩双方曾就一张画爆发了激烈的争议，这幅画就是张大千的青绿山水画，是文强单笔受贿中最大的一笔。在公诉人出示的鉴定结论书中，重庆市价格认证中心将张大千的画归入文物之列，鉴定其价值高达364万。

　　最终重庆法院对涉案的364万元字画未予以认定。为啥？当时法庭请国家文物局专家进行了鉴定，专家的鉴定结果是：文强收受的“青绿山水画”为普通赝品，且非高仿品。

　　文强在“风雅圈儿”中混迹那么久，应该还是有点儿眼光的吧，而且据称，重庆市公安局公共交通治安管理总队原副总队长赵利明送画时，随画一起还送来了鉴定证书以及37万余元的价格标注，文强问道“这是不是张大千的画呀，现在哪有那么多真的呀”。

　　瞅瞅，还当真是赝品，连高仿都不算。

　　顺道提一句，很多“风雅贪官”都喜欢收藏张大千的作品，但也有的官员却把送到手的张大千画退回去。

　　徐州市人大常委会原副主任丁维和就曾主动退还了一幅张大千书画作品，但先别为他叫好，他主动退还的原因并不真的是“无欲则刚”，而是“害怕”。 “张大千的画很贵重……我担心出事就把画还他了。”在丁维和被讯问时，坦承自己是“怕出事”，怕张大千的作品太“扎眼”。

　　“东城老郭”收的画还有假？

　　“东城老郭”这个称号，大家听过吗？

　　上个世纪90年代中期，“东城老郭喜欢名人字画”曾在京城律师界尽人皆知，说的是谁？就是原西城法院院长郭生贵。

　　郭生贵的这个“雅好”可不是天生的，一位曾和郭生贵共事多年的东城法院法官就对媒体表示，早期可从未听说郭生贵有字画的爱好。后来，很多律师花大价钱购买名人字画送给郭生贵，而在这种你来我往中，郭生贵对字画的鉴赏能力也逐步在提高。

　　律师界曾广泛流传一个说法：有当事人到郭生贵的办公室送上两幅字画。接过画后，郭便迅速到里间鉴别，然后很客气地将其中一幅退了回去。后来当事人才发觉，郭退回的那幅是赝品。

　　但就是这么一个已经炼成“火眼金睛”的人，在法庭上，对于检方指控他收受的三幅价值昂贵的名人字画，法院最终却没有认定。

　　为啥？由于对字画的真伪和价值没有统一和权威的认定标准，法院认为不能完全排除对于字画真正价值的合理怀疑。

　　政知道再来说说曾震动一时的“河北第一秘”——河北省国税局原局长李真。

　　李真案宣判后，他受贿所得的收藏品及珍贵物品拍卖会曾经轰动全国，但不少字画，却被明眼人一眼戳穿是赝品。

　　“一眼看上去就知道是赝品，整幅画画得跟附上去的一样，两只鹰没有一点神，再看徐悲鸿的印泥都跑油了，怎么可能是真的呢？”“黄胄的《驴》，也真不了。黄胄是以速写入画，线条流畅，但这幅画的笔锋、线条都很呆板，一看就知道是照着画册临摹的”，一位河北省书法家协会会员在拍卖会上估计，字画中约有三分之一是赝品或次品。

　　而且在最先拍卖的字画中，65件拍品只有26件标出了起拍价，其余39件拍品不能保真。

　　“赝品”也有“实用”功能？

　　不少官员都曾收到“赝品”，但有一个地方的贪腐官员却似乎独具鉴定能力。有媒体曾经报道，山西落马官员贪腐金额多的原因之一，就是在山西贪腐官员的家中，发现了大量古玩字画，而且往往真迹居多，赝品极少。

　　真迹，就意味着估价高，最后被认定的受贿金额就比较大。

　　当然，话说回来，有些官员收“赝品”是“被骗”，但也有人收“赝品”是故意，毕竟有些“赝品”虽然不能保值增值，但好歹能洗钱用啊。

　　据官方媒体报道，赝品可以通过不合法的渠道被鉴定为“真品”，然后送给这些“雅官”，然后行贿者以“雅官”名义将赝品拍卖，行贿者再指定竞买人举牌高价竞买，这样的话，受贿者就以隐秘方式获得钱款。再比如，“雅官”将赝品放到某经销商处，然后有意无意告知行贿者自个儿的收藏雅好，让这些行贿者到指定经销商处高价购买。一位检察人员就表示，不少贪腐案件的突破性线索可是从拍卖公司或经销商处获得的。

　　出售”赝品”也是受贿方式之一

　　有故意收藏“赝品”的，也有故意出售“赝品”的。广东省委办公厅原副主任、省公安厅原党委副书记蔡广辽被控受贿案5月13日在广州中院开庭。在检方指控的6单犯罪事实中，有3单和蔡广辽的文物收藏爱好有关。

　　指控称，2006年至2013年，蔡广辽为商人纪镇武多次提供便利，先后16次收受纪镇武所贿送的人民币60万元，港币160万元，以及出售瓷瓶、佛像等“古董”的方式收受纪镇武所贿送的人民币179.11万元。

　　纪镇武2006年第一次到蔡广辽家时，就购买了3个“古董”瓷瓶，蔡广辽以每个10万元的价格卖给了纪镇武。但是后来经鉴定，这三个瓷瓶都是现代工艺品，每个的价格为300元。庭审透露，这批瓷瓶是蔡广辽及其妻子在江西井冈山购买的。

　　此后，纪镇武多次高价向蔡广辽购买“古董”佛像、瓷瓶等物，其中2007年花100万元买过一个“古董”瓷瓶，但纪镇武看出瓷瓶是假的，将其退还给蔡广辽后，蔡广辽并没有将钱退给纪镇武。但是蔡广辽的律师认为，蔡广辽并不知道古董是假的。

　　厦门远华走私案主角赖昌星有一句话：“不怕领导讲原则，就怕领导没爱好。”上面这些雅官，为了自个儿的“爱好”收了不少东西，但不管收“赝品”是被摆一道还是有意为之，抑或是通过出售“赝品”的方式受贿，说到底，都是“贪”！
