最高检：侵犯公民人身自由权每日赔偿242.3元

　　中新网5月16日电 最高人民检察院5月16日下发通知，要求各级人民检察院办理自身作为赔偿义务机关的国家赔偿案件时，执行新的日赔偿标准242.3元，该标准较上年度增加了22.58元。

　　据最高检刑事申诉检察厅有关负责人介绍，国家赔偿法第三十三条规定：“侵犯公民人身自由的，每日赔偿金按照国家上年度职工日平均工资计算。”国家统计局2016年5月13日公布，2015年全国城镇非私营单位在岗职工年平均工资为63241元。根据上述法律规定、统计数据以及人力资源和社会保障部提供的日平均工资的计算公式，对属于侵犯公民人身自由的国家赔偿案件，最高检刑事申诉检察厅确定了新的日赔偿标准为242.3元。另据《最高人民法院、最高人民检察院关于办理刑事赔偿案件适用法律若干问题的解释》第二十一条第二款规定，各级人民检察院自2016年5月16日起执行该日赔偿标准。
