　　检察机关指控，2002年间，陈柏钊担任广州市白云城市建设开发有限公司董事长、总经理、法定代表人以及白云城建公司深化企业改革筹备小组领导小组组长，利用职务上的便利，在白云城建公司由国家出资企业向民营股份制企业转制过程中，故意不向资产评估公司提供公司133套房产(价值4459万多元)的有关资料，导致该部分资产因资料不全，仅被核定为260多万元，造成国有资产流失共计4199万多元。

　　在转制完成之后，陈柏钊将该133套房产出手，所得售房款共计5962万多元，陆续转入其个人名下的储蓄账户、理财账户或者用于购买个人房产、购买个人职工股等。

　　另查明，白云城建公司转制前，由公司会计人员保管的“小金库”上有余额人民币400多万元，转制时该笔款项也未纳入资产评估。转制后，陈柏钊要求将该笔款项共计469万多元移交给其本人，并陆续转入其个人银行账户，占为己有。

　　检察机关认为，被告人陈柏钊身为国家工作人员，利用职务上的便利，侵吞公共财物，其行为触犯了刑法，应当以贪污罪追究其刑事责任。
