　　律师:法律对警方打马赛克无明确规定

　　对于警方此类“顽皮”的打码方式，既有网友为其点赞，表示曝光得好，也有网友质疑，不正儿八经地打马赛克会侵犯被捕者的肖像权。

　　马赛克究竟该给谁打?怎么打?北京律师张新年说，除了《未成年人保护法》第五十八条规定，对未成年人犯罪案件，新闻报道、影视节目、公开出版物、网络等不得披露该未成年人的姓名、住所、照片、图像以及可能推断出该未成年人的资料。其他的成年人犯罪案件，目前法律并无明确规定，但实践中，重大案件的犯罪嫌疑人，警方往往不打马赛克。

　　他认为，对于治安案件违法者乃至情节不重的一般犯罪嫌疑人，都有必要打上马赛克。公权力惩治违法犯罪者的同时，也尊重和保护其合法权益，他们受到法律制裁之后，还要回归社会，应该保障其隐私权。

　　而北京京都律师事务所律师常莎此前曾对新京报记者表示，未最终做出生效判决前，不打码公布犯罪嫌疑人的照片，有使公众对犯罪嫌疑人进行有罪推定的嫌疑。

　　那么，什么时候警察也会打上马赛克?张新年说，除了警察自己不愿曝光个人面部信息的情况外，如果警察从事的是卧底类的工作，打马赛克有助于保密。

　　对上述给小偷打“鼻贴”、给抢夺儿童的嫌犯打文字马赛克的行为，张新年表示，对这类违法者曝光有助于维护社会安全，可以公开。
