“经查，这个1千瓦的照明灯是酒店自设灯光，并不属于我们的管辖范围。”普陀区景观所工作人员向记者介绍，根据现有法律法规，像酒店自设照明灯这样的社会灯光，究竟该归谁管理，目前国家还没有一部明确的法律法规加以规范和约束，更没有明确的监管部门。
“在这种情况下，我们只有两种选择，第一是告知居民此类情况不属于景观所管辖范围，第二是帮忙协调酒店一起寻找解决方案。”景观所工作人员介绍，本着把居民诉求放在第一位的原则，景观所答应居民与酒店方沟通协调，尽快给出一个解决方案。
在与酒店方和居民反复沟通中，景观所把居民实际困扰与酒店方停车照明需要相互协调，终于商量出了一个双方都满意的解决方案：朝南方向的照明灯关闭，朝西方向的照明灯调整角度避免直射居民窗户，并在照明灯上加了一块挡板，将灯光对居民的影响降到最低，最终圆满解决了双方矛盾。
景观灯光将有管理办法
记者从普陀区景观所了解到，实际上近期该所接到的相关“光污染”投诉并非个例，除了酒店灯光夜晚扰民，还有玻璃幕墙反光等等投诉，但由于“光污染”并无相关管理办法，也让景观所在工作中缺乏执法依据，只能以调解为主。
据介绍，现有的城市灯光主要分为三种：一种是像马路路灯等市政灯光，一种是像外滩、苏州河边上的景观灯，还有一种就是各种企业、居民家用的自有灯光。前两类都有明确的管理部门，前者属于电力或者市政部门管理，后者属于辖区景观所管理，但第三类社会灯光目前基本上是由业主自行管理。
对于各类光源的管理，目前本市仅依据相关环保法规，市容管理条例等进行，在细则上并无明确管理办法。记者从普陀区绿化市容局获悉，目前本市正在制定《上海市景观灯光管理条例》，随着该条例正式颁布，景观灯光的管理将有统一条例。

居民遇到“光污染”究竟该如何维权？记者采访获悉，首先要搞清楚“光污染源”的管理部门，第一种如果是路灯照明给居民造成困扰的话，可以向市政管理部门进行投诉；第二种如果是景观灯造成扰民，可向辖区景观所投诉；第三种如果是社会灯光造成的投诉，也可以拨打市容环卫热线投诉。不过，环卫部门也只能以协调为主，遇到扰民方拒不配合的话，最后还可以走诉讼途径。
